In respect of business connected with sales, purchases, leases, mortgages
and other matters of conveyancing, and in respect of other business not being
transacted in court or in chambers, and not being otherwise contentious
business, the solicitor’s remuneration shall (in the absence of any agreement to
the contrary) be regulated by the conveyancing scale charges for the time being
in
force:
Provided that, in cases of sales
of mortgaged properties, the trustee’s solicitor shall be entitled to percentage
only upon so much of the proceeds of sale as shall not be chargeable by the
mortgagee’s solicitor with the percentage, and such percentage shall be payable
only out of the proceeds of
sale.
