NOTIFICATION of the Judge’s decision (Ord 53 r 3)
Following:
Order by Deputy High Court Judge (Non-refoulement Claims) Martin Wong:
1. Leave to withdraw the application for leave to apply for judicial review be granted; and
2. The application for leave to apply for judicial review be dismissed.
Observations for the Applicant:
Introduction
1. By a Form 86 filed on 21 February 2023 (the “Form 86”), the Applicant applied for leave to apply for judicial review of a decision by the Torture Claims Appeal Board (the “TCAB”) dated 9 December 2022 (the “TCAB Decision”), which affirmed a decision by the Director of Immigration (the “DOI”) dated 29 June 2021 in refusing the Applicant’s non-refoulement protection claim. He named the TCAB as the proposed respondent and the DOI as an interested party.
2. The Applicant requested for a hearing and he attended the same.
Withdrawal
3. Subsequent to the hearing, by an affirmation filed on 20 May 2026, the Applicant made an ex-parte application to withdraw this application for judicial review. It is affirmed therein that he now wanted to return to his home country as he considered his life to be safe there.
4. There is nothing to indicate that the Applicant’s decision to withdraw his application was made other than out of his own free will and there is nothing outstanding in this action, I therefore accede to the withdrawal application and formally dismiss this Form 86 application.

c) supply to every other party copies of every affidavit which the Applicant proposes to use at the hearing, including the affidavit in support of the application for leave (Order 53, rule 6(5)).
