Mr Dennis K H Ting, of Messrs Tse Yuen Ting Wong, for the Defendant |
| Offence: |

(2) Assaulting a police officer (襲擊執行職責的警務人員) |
---------------------
Reasons for Sentence
---------------------
1. The defendant pleaded guilty to one count of possession of a dangerous drug and one account of assaulting a police officer.
2. Facts revealed that on 26 March this year at around 3.23 am, you were stopped and searched by the police and it was found in your possession a plastic bag, containing 2.55 grammes of powder and containing 1.89 grammes of ketamine. During the arrest, you assaulted a police officer who suffered from superficial injuries as a result. You were subsequently subdued by both police officers.
3. The court asked for a DATC report before sentencing. The report confirmed, amongst other things, that you were no longer a drug dependent.
4. In sentencing you, I will take into account your plea of guilty, the mitigation put forward by your counsel and also the totality principle.
5. For each charge, I will take six months’ starting point because of your plea, I reduce it to four months and the sentence is to run concurrently to each other; meaning the total sentence being four months.
