原告人的索償及案情

1.  原告人作供時指稱在2018年2月17日，被告人用一把彎刀襲擊她致其受傷，因而以人身侵害 (trespass to person) 為訴因向被告人提出索償。

2.  原告人於1954年12月28日出生，現年 70歲。原告人的兒子和新袍、孫兒曾經和原告人及其丈夫一起居住於事發位於將軍澳的單位。大約於2014年，兒子一家三口搬離了將軍澳單位，但在新袍建議下，新袍的媽媽（即被告人）便搬到將軍澳單位與原告人及其丈夫和女兒一起居住。據原告人所述，她與被告人一起居住時，被告人經常無理取鬧，並多次以剪刀或煮食用具恐嚇她。在事發當日，即2018年2月17日，原告人與被告人因着一些掛在洗手間門上的衣物發生爭執，雙方並有肢體上的碰撞。期間，被告人把原告人推倒在一張餐椅上，並用一支彎刀襲擊原告人的左手和頸部，令其受傷。

3.  本案不爭議的是事發後，被告人被控意圖使原告人身體受嚴重傷害而非法及惡意傷害她，及在有關單位內威脅原告人會使她的人身遭受損害，意圖使原告人受驚兩項控罪，並且在區域法院經審訊後[1]，在2019年6月5日被裁定兩項罪名成立，並在2019年6月28日就上述第一項及第二項控罪分別被判監24個月及 9個月，兩項控罪刑期同期執行。

被告人的案情

4.  被告人承認把原告人推到一張凳上，並拿 起一把彎刀襲擊原告人，並鎅傷原告人的頸及手，但被告人聲稱她沒有意圖把原告人推倒在一張凳上及拿一把彎刀傷害原告人的頸及手。

5.  另外，被告人依賴兩份精神科醫生Dr. Amy C.Y. Liu （「廖醫生」）日期為2018年2月28日及2018年12月6日的報告（“該兩份報告”），指她患有妄想型精神分裂症（Paranoid Schizophrenia ）。該兩份報告是在裁判法院提取的，而在判刑前，區域法院法官亦作出命令替被告提取了另外兩份精神科報告，其中一份亦是廖醫生撰寫的。

責任問題的適用法律

6.  原告人依賴侵權法中人身侵害 (trespass to person) 的「毆打」(battery) ，並援引以下的法律典據及確立的法律原則：

(a)  在Chang Yuen Sheung 對 Lo Fung, [2024] HKDC 1111，第7段，法庭指出：

「“毆打”是指對他人作出任何直接及非自願的身體接觸，原告人毋須證明該身體接觸造成或可能造成任何實質身體傷害，亦毋須證明被告人有意圖對他作出傷害：余嘉銳 訴 莊志輝 DCPI 1994/2014（2017年2月10日）第15及16段；Mai Chisheng 訴 Ng Ping Lam [2024] HKDC 131 第15段；Clerk & Lindsell on Torts（第24版）第14-09段。」

(b)  原告人只需要證明被告人是有意圖作出「接觸」或「毆打」（即使被告人只是意圖傷害其他人，但接觸了原告人亦可），而該「接觸」或「毆打」是直接及立刻影響到原告人 （Tort Law in Hong Kong, 5^th Ed (2023), 第634頁）：

“…If one man intentionally applies force directly to another, the [claimant] has a cause of action for assault and battery, or, if you so please to describe it, in trespass to the person ... If he does not inflict injury intentionally but only unintentionally, the [claimant] has no cause of action today in trespass. His only cause of action is in negligence, and then only on proof of want of reasonable care.

…

Battery, assault, and false imprisonment involve the direct and immediate application or threatened application of force to the person, and for that reason they are all described and classified as “trespass to the person”. The features common to these three torts are that they are intentionally committed against a person, and they are committed through direct and immediate means. Directness and immediacy will be discussed in the context of battery (15.2 below). Intention requires that the relevant consequence (contact, apprehension or detention) must have been desired.”

“…The two distinctive features of trespass were that it is actionable per se and that the interference with the claimant’s interest has to be a “direct” consequence of the defendant’s act…＂ §14-01

“…When the defendant is proved to have intended to commit a battery against X, and by mistake strikes Y, that is a battery against Y. Thus, when a soldier fires into the crowd at a rioter intending to strike him, but misses and strikes another person nearby, it is no defence that the defendant did not intend to strike the claimant. The defendant’s intention relates to the act constituting trespass; there is no requirement that the defendant intended to harm the claimant…”

(c) 該身體接觸的程度需要是超越日常生活普遍接受的接觸（Clerk & Lindsell on Torts, 24^th Ed, 第14-10段）：

“.. whether there was any physical contact imposed on the claimant in excess of that “generally acceptable in everyday life”…”

(d) 關於被告人提出的抗辯，即她沒有意圖傷害原告人，只要被告人有能力知道她行為的性質，即使是因為她的疾病而導致她作出有關的行為，這並不是一個抗辯理由（Clerk & Lindsell on Torts, 24^th Ed, 第14-4段）:

“...A blow inflicted in a state of automatism is no battery, but if the defendant intended to strike the claimant it is no defence simply that, by reason of mental incapacity, he did not know that what he was doing was wrong... ”

“…Note that the “intention” necessary for this tort relates to the contact with the plaintiff and not to the infliction o f injury. Intention to injure is not a requirement of battery (Wilson v Pringle [1987] QB 237). Knowledge of wrongdoing is not even a requirement. An attack by a person with a diseased mind is a battery, so long as the bodily contact was intended (Morriss v Marsden [1952] 1 All ER 925)…”

另見上述Morriss第928E-F頁：

“…but I have come to the conclusion that knowledge of wrongdoing is an immaterial averment, and that, where there is the capacity to know the nature and quality of the act, that is sufficient although the mind directing the hand that did the wrong was diseased...”

7.  在Morriss一案中，被告人是一位患有精神分裂的病患者，但他在事發的時候清楚知道他行為的性質，而不是在處於「自動狀態」(condition of automatism) 或催眠或是出神 (trance) 狀態。 法庭判定該被告人需要對他的毆打行為負上民事責任： 見Morriss 第926H - 927H頁：

“…the defendant was not in a condition of automatism or trance at the time of the attack on the plaintiff, but that his mind directed the blows he struck, and that at the material time he was a catatonic schizophrenic and a certifiable lunatic who knew the nature and quality of his act, but whose incapacity of reason arising from the disease of his mind was of so grave a character that he did not know that what he was doing was wrong…＂

“... For example, I think that, if a person in a condition of complete automatism inflicted grievous injury, that would not be actionable. In the same way, if a sleepwalker inadvertently, without intention or without carelessness, broke a valuable vase, that would not be actionable... ＂

8.  原告人亦依賴被告人在區域法院經審訊後並被裁定罪名成立的事實。原告人援引《證據條例》（第8章）第62(1)和62(2)條。該兩條訂明如下：

「(1) 在任何民事法律程序中，任何人曾在香港就任何罪行被任何法庭定罪或在任何法庭席前被定罪的事實，在不抵觸第(3)款的條文下，以及在證明該人曾犯該罪行是與該法律程序中的任何爭論點有關聯的情況下，可接納為證據，以證明該人曾犯該罪行，而不論該人是於認罪後或以其他方式被定罪，亦不論該人是否該民事法律程序的一方；但除存續的定罪外，其他定罪均不得憑藉本條可接納為證據。

(2) 在任何民事法律程序中，如憑藉本條而證明任何人曾在香港就任何罪行被任何法庭定罪或在任何法庭席前被定罪，則——

(a) 除非相反證明成立，否則該人須視作已犯該罪行；及

(b) 在不影響為對該定罪所據的事實作識別而進行收取任何其他可接納的證據下，可接納為該定罪的證據的任何文件的內容，以及將所涉及的人定罪所據的告發、申訴、公訴書或控告書的內容，均可為上述目的而可接納為證據。」

9.  由於被告人已在刑事法庭被定罪，在本案中法律上的舉證責任 (legal burden of proof) 便轉移到被告人身上。被告人需要證明區域法院的定罪是不妥當的。原告人強調在本案中法庭需要謹記被告人是在不認罪後經過審訊而被裁定有罪：Hunter v Chief Constable of the West Midlands Police and Others [1982] AC 529, 第543B-D頁 per Lord Diplock:

“…In contrast to this a decision on a particular question against a defendant in criminal case, such as Bridge J.'s ruling on the voir dire in the murder trial, is reached upon the higher criminal standard of proof beyond all reasonable doubt and is wholly inconsistent with any possibility that the decision would not have been against him if the same question had fallen to be decided in civil proceedings instead of criminal. That is why convictions were made admissible in evidence in civil proceedings by the Act of 1968….”

另見Lau Ka Po (A Minor) v Man Cheuk Ming and Another, HCPI 584/1996 (10/03/1997), 張澤佑法官（當時官階）於第9-10 段提出：

“9. The effect of a conviction of careless driving shifts the burden of proof to the 1^st Defendant to show that he was not negligent. It appears that this point has been ignored in many of the road traffic cases where despite the criminal conviction of the driver, the issue of liability was contested right up to the moment of trial. Much time and legal costs could be saved if the handling lawyers could face the real issue, agree on liability at the early stage of the proceedings and concentrate their efforts on quantum. I will repeat what Lord Denning said in Stupple v Royal Insurance Co Ltd [1971] 1 QB 50, on s11 of the Civil Evidence Act (the equivalent of s62 of the Evidence Ordinance) :

“The Act does not merely shift the evidential burden, as it is called. It shifts the legal burden of proof. ..... Take a running down case where a plaintiff claims damages for negligent driving by the defendant. If the defendant has not been convicted, the legal burden is on the plaintiff throughout. But if the defendant has been convicted of careless driving, the legal burden is shifted. It is on the defendant himself. At the end of the day, if the judge is left in doubt the defendant fails because the defendant has not discharged the legal burden which is upon him. The burden is, no doubt, the civil burden. He must show, on the balance of probabilities, that he was not negligent: ..... But he must show it nevertheless. Otherwise he loses by the very force of the conviction.

.....

In any case, what weight is to be given to the criminal conviction? This must depend on the circumstances. Take a plea of guilty. Sometimes a defendant pleads guilty in error: or in a minor offence he may plead guilty to save time and expense, or to avoid some embarrassing fact coming out. Afterwards, in the civil action, he can, I think, explain how he came to plead guilty.

.....

In my opinion, therefore, the weight to be given to a previous conviction is essentially for the judge at the civil trial. Just as he has to evaluate the oral evidence of a witness, so he should evaluate the probative force of a conviction.

If the defendant should succeed in throwing doubt on the conviction, the plaintiff can rely, in answer, on the conviction itself; and he can supplement it, if he thinks it desirable, by producing (under the hearsay sections) the evidence given by the prosecution witnesses in the criminal trial, or, if he wishes, he can call them again. At the end of the civil case, the judge must ask himself whether the defendant has succeeded in overthrowing the conviction. If not, the conviction stands and proves the case.”

10. In the present case, I find that the 1^st Defendant had not succeeded in overthrowing the conviction. The evidence established that he was negligent in the collision…”

責任問題

10.  正如原告人所述，上述區域法院刑事案件DCCC 335/2018 審訊時，法官已考慮該兩份報告，並傳召了廖醫生作供。 最後，法庭裁定被告人是有意圖傷害原告人。

11.  事實上，廖醫生在她的三份報告中從來沒有指出被告人 在案發的時候是沒有能力知道她自己行為的性質，亦沒有說她在案發時是處於「自動狀態」(condition of automatism) 或者是「催眠狀態」 或「出神狀態」（trance）。

12.  根據廖醫生於案發後第一天所作出的第一份報告， 被告人具有能力明白控罪及法庭的程序，因此她精神上是適合進行答辯的 (mentally fit to plead)。

13.  被告人指她的精神病情影響了她的判斷力， 使她誤會了原告人當時拿著剪刀以及對被告人作出迫害，但其實原告人只是拿著手提電話。 可是，如上所述，在法律上這並不構成抗辯理由。

14.  本席在考慮本案的相關證據之後，認為本案案情清楚直接，被告人在事發時確實知道她的行為會導致原告人受傷。因此，本席裁定原告人已提出足夠證據證實及確立了被告人的責任。

賠償金額

原告人的求診過程

15.  原告人在受襲後，由於全身多處受傷，被送往將軍澳醫院急診室救治。檢查發現原告人頸部、右手無名指及尾指撕裂，左手拇指和左手食指亦有割傷。原告人初步被診斷為頸部受到穿透性外傷，以及雙手割傷。

16.  由於傷勢嚴重，原告人其後被轉送伊利沙伯醫院急診室接受進一步治理。轉院後，原告人在伊利沙伯醫院急診室接受診治。原告人其後被轉往伊利沙伯醫院骨科及創傷科。經體檢後，原告人被發現有5條肌腱被割斷，臨床診斷為頸部受到穿透性傷害及手部受傷。

17.  原告人入院當晚 （即2018年2月17日）接受了緊急手術。 根據專家報告及伊利沙伯醫院報告，手術中發現原告人傷勢如下：

(a)  右手拇指：尺背側拇指撕裂3厘米，伸肌腱切斷；

(b)  右手食指：2公分傷口，肌腱和指神經和血管完好無損；

(c)  右手中指：掌指關節處1 公分裂傷，肌腱和指神經和血管完好無損；

(d)  右手無名指：遠端指骨、遠端指間關節及中指骨上的橫行性撕裂傷；

(e)  右手尾指：尾指指腹撕裂傷，遠端指間關節及中指骨橫行掌側撕裂傷，1區指深屈肌腱完全切斷；小中指骨尺骨髁骨折；

(f)  左手拇指：原告人拇指尺側掌側有3公分裂傷，屈肌腱、神經及血管完好。掌指關節背側另一2 厘米撕裂傷，拇長伸肌EPL100%切斷；

(g)  左手食指：食指上方手掌2公分裂傷，肌腱、神經及血管完好；

(h)  左手中指靠近掌指關節的2公分撕裂傷，完全切斷二伸肌。

18.  醫生安排原告人接受肌腱和神經均修復，並給予原告人雙側平板保護。手術後，原告人需入住深切治療部接受密切監護，並於2018年2月18日轉至骨科病房接受進一步治療。

19.  其後，由於原告人右手無名指和尾指疼痛，她於2018年4月9日至2019年9月13日期間接受職能治療46次。首次就診時，原告人的右手和尾指仍留有假指甲， 而原告人右手拇指尺側有三道疤痕，橫跨遠端指骨、指間關節和近節指骨。 另外，她的右手食指遠端指骨掌側和右手中指掌側發現有兩個疤痕。她的左手所有掌指關節均明顯腫脹。

20.  另外，原告人食指、中指及右手掌關節的疤痕偶爾疼痛，頸部亦留有超過3處橫向疤痕，但原告人不會考慮進行進一步手部手術。經諮詢後， 醫療師建議原告人繼續接受疤痕按摩技術，並建議繼續使用左手壓力衣手套、壓力墊、左手屈曲手套、左尾指夾板、右尾指卡彭納夾板和左第一網擴張器。

21.  除了接受職能治療，原告人亦經九龍醫院骨科及創傷科轉介後，因右手拇指、右手指、尾指、左手拇指及中指肌腱受傷，到將軍澳醫院物理治療部就診。原告人於2018年4月9日至2018年9月4日開始接受物理治療共19次。 主觀檢查顯示，原告人主訴右手傷口和疤痕疼痛， 以及左手疤痕疼痛，疼痛強度為5至6分（滿分為10分），且右手無名指和尾指感到麻木。另外，客觀檢查發現原告人的右手無名指、尾指、左手拇指腫脹， 而左手第一指腹處有觸痛的結痂。 她在手部課程中接受了磁脈衝超音波和手指電刺激、手指活動和強化練習。

22.  於2018年4月26日，原告人因右手無名指及尾指疤痕持續緊繃及壓痛，左手食指亦有輕微緊繃及壓痛，於伊利沙伯醫院專科門診接受跟進治療。她在2018年10月26日，因短暫突發性的回憶和惡夢而到容鳳書精神科中心就診，至今原告人仍在該中心接受治療。

23.  由於本案中的事故，原告人獲發從2018年2月17日至2018年11月8日共265天病假。

24.  除上述情況外，原告人亦經骨科診所轉介至基督教聯合醫院疼痛診所。原告人首次於2021年初到疼痛診所就診， 到現在每半年進行覆診。就診過程中，骨科診所發給原告人止痛藥。

原告人現時的狀況

25.  即使原告人被斬傷了的多隻手指經醫生透過手術已盡量修復， 但是手指靈活度大不如前。 是次意外同時對原告人的心理及日常生活及工作亦做成很大影響。 例如，原告人變得很難入睡，即使能夠入睡原告人很容易驚醒， 亦經常發惡夢，夢見被告人要求原告人搬離開事發單位等畫面，嚴重影響其睡眠質素。

26.  此外，意外後原告人經常回憶起與被告人爭吵的零碎片段，導致原告人精神緊張， 因此原告人需要前往容鳳書專科門診接受精神科治療及服用醫生處方的精神科藥物 ，才能舒緩上述問題。

27.  原告人受傷的手指均有不同程度的傷勢， 而每個受傷部位帶來的不便，嚴重影響原告人的日常生活。 儘管事故發生至今已3年多，但她的右手仍然感到痛楚。由於她右手的無名指及尾指被斬至斷筋，所以右手無名指及尾指還時常感到針刺痛、痠痛及趾痛。除了痛楚外，因為她的手指神經線被斬斷，她會感到麻痺。 總括來說，原告人雙手的手指受到不同程度的傷患，分別為右手的拇指、無名指、尾指及左手的拇指、中指。她的傷勢可總括如下：

(a)  左手拇指：被刀斬致拇指關節斷筋，如果把右手拇指屈曲便會感到痛楚，所以左手拇指不能正常的屈曲，只可以微曲，因為把拇指屈曲便會扯住痛及麻木；

(b)  左手中指：左手中指以下手背被斬致斷筋，時常感到扯痛、痠痛、針刺痛及不時隱隱作痛及麻木；

(c)  右手拇指：右手拇指近關節處斬致斷筋，雖然事故至今已有3年，但是觸碰仍然會感到痛楚；

(d)  右手無名指：右手無名指被斬致斷筋，皮肉掉下來，需要聯針縫合，而右手無名指不能伸直，時常感到麻痛痠痛、扯痛及針刺痛、麻木及變形。

28.  意外至今，原告人的右手於晚上睡覺時需要佩帶手護套。手護套的作用是固定手指的位置，防止手指的筋萎縮及變形。此外，於上班時，原告人的左手亦需要佩帶手護套及右手的尾指需要尾指彈弓套。 由於左手中指不能屈曲，佩帶上護手套可以拉鬆左手中指的筋，使左手中指能夠屈曲。原告人右手的尾指亦需要佩戴尾指彈弓套，作用是透過彈弓的阻力鍛鍊右手尾指的筋腱，防止尾指筋鍵萎縮。

29.  另外，原告人亦感受到右手寫字困難。 由於原告人的主用手為右手， 事發後， 由於她右手手指被斬傷，即使經醫生做手術修復後至今，仍然感到痛楚及麻痺，於每次只能作短時間的書寫。如果大約書寫10分鐘左右，她的右手便會感到痛楚及麻痺。在工作上，書寫困難的問題會影響及減慢原告人的工作效率， 並減少她的競爭力。

30.  原告人亦不能以右手支撐身體。 由於她右手手指被斬傷，右手手指的痛楚及不適，使她的右手在日常生活及工作中不足以支撐身體。例如，如果她把右手張開手掌按在桌上或是於下床的時候按在床上，原告人的右手手掌於受力的瞬間便會感到痛楚，所以原告人只可以把右手手指屈起，右手握拳並用右手手背按在桌子上或床邊才能夠支撐身體， 因此影響及減慢了她的活動能力。

31.  原告人雙手亦不能發力及拿東西。 由於雙手手指被斬傷，原告人再便不能拿重物。在日常生活中，即使如前往街市買食物等簡單行為，原告人需要使用手推車輔助及尋找家人幫忙。在工作時，作為保安員的她不時都需要搬運重物， 因此在受傷後，原告人時常需要其他保安員的協助，影響了工作上安排。 另外，即使是拿取一些重量較輕的物品，原告人亦不能穩妥地拿着， 並且容易弄跌物品。在生活上，即使是一些簡單的家務，原告人也不能輕易進行。

32.  另外，原告人亦受到創傷後遺症困擾， 時常感到十分驚慌並且心跳急速，害怕隨時會被人攻擊或再一次遇襲受傷。她的食慾亦受到很大影響，以及不能入睡。醫生後來給予原告人精神科藥物以減輕其遇襲後創傷後遺症的症狀。

33.  在原告人出院時，醫生曾要求她定期到伊利沙伯醫院的精神科覆診，可是由於她雙手仍然感到十分痛楚，原告人乘坐巴士前往伊利沙伯醫院時連緊握巴士的扶手也沒有力， 因此感覺十分不方便，所以原告人甚至不願意前往伊利沙伯醫院的精神科覆診。

34.  在出院回家後初期，原告人經常覺得心跳加快， 並且經常感到全身乏力，做極少量的活動也感到十分吃力。於2018年10月26日，原告人經醫生轉介開始到容鳳書精神科門診接受精神科治療，至今仍繼續進行有關治療。 就這方面，專家的報告亦指出原告人是有 創傷後調節問題 (“adjustment reaction towards the incident of assault”)。

專家報告

35.  為了本案的申索，原告人於2021年12月30日接受雙方 骨科專家林自強醫生 (Dr. Lam Chi Keung, Johnson) 及高拔萃醫生 (Dr. Ko Put Shui, Peter) 的檢查。

36.  專家報告指原告人的傷勢是穿透性外傷， 直接傷及筋絡神經及骨骼。根據專家報告第51段及53段，原告人的受傷而引致永久喪失賺取收入能力是14% 或9.5%， 而整體個人的損害 (whole person impairment) 則為10.5%及9.5%。

37.  雙方專家報告亦同意及說出了原告人後遺症的成因，以及原告人的後遺症跟她的傷勢是吻合， 而原告人選擇不去接受其他手術是合理的：

“40. There was some improvement over time; but there was still residue impairment (numbness likely due to ulnar digit nerve cut (despite repair) and stiffness/ flexion contracture of the injured fingers (likely due to tendon injury and scarring)...”

“42. For the contractures and stiffness (especially the one over the ring and little fingers), theoretically, further surgery such as tenolysis and scar release may decrease the contracture; however, in some patients with strong "scar-response", further surgery may induce more scarring and sometimes even more stiffness - Madam Choi's inclination/ decision for non-operative treatment is reasonable and acceptable…”

“45. At the time of this assessment, Madam Choi still complained of pain, numbness, stiffness and tightness in the injured digits of the hands; and also occasional pain over the neck scars - these are consistent with the objective physical findings and the nature and severity of injuries (with nerves cut and repaired, with residue numbness and pain especially in the areas supplied by the severed digital nerves / superficial nerves; and with tendons cut and repaired, with residue stiffness and even contracture likely related to residue adhesion and scarring), and are likely residue pain and impairment as a result of the subject injury. The alleged occasional pain over the necks scars are also consistent with the multiple cuts in the neck resulting in multiple scars…”

“46.Dr Lam & Dr Ko: On examination, the findings tabulated above are consistent with the nature and severity of the injuries and subjective complaints at this assessment.”

痛楚、痛苦、及失去生活樂趣的賠償

38.  原告人對自己的傷勢及其影響並無誇大之處，法庭予以採納。 原告人援引下列有關痛楚、痛苦、及失去生活樂趣賠償的案例， 賠償由30萬元到60萬元給法庭參考：

(a)  Xia Yunbiao v Kong Po Choy t/a Sun Kong Decoration Co [2019] HKCFI 2775：原告人是一名建築工人。於2015年10月10日，當原告人右手拿著瓦仔機切木板時，瓦仔機突然失控反彈，割傷原告人左手拇指引致骨折。檢查顯示原告人左手拇指割傷，傷口深入見骨，懷疑筋斷。X光掃描檢查顯示原告人左手拇指骨折，伸拇長肌 (extensor pollicis longus tendon) 30% 斷裂。原告人同日接受手術修復了腱 (tendon) 和關節囊 (joint capsule)。原告人接受手術，固定左手拇指。原告人從指尖到指間關節有一道5 厘米長的疤痕，指甲有輕度畸形，指甲床受壓時有壓痛， 拇指尖麻木而且左手拇指的指間關節僵硬，還有左手握力受損。原告人受傷嚴重，骨折涉及關節、韌帶和肌腱，預計會繼續出現疼痛、無力和僵硬的狀況。原告人亦有牙髓萎縮 (pulp atrophy) 和強直 (ankylosis)，這為嚴重受傷後的典型體徵。由於原告人的左手拇指僵硬，醫生建議對原告人的左拇指進行手術。原告人的左手拇指仍會疼痛、麻瘅及僵硬，而勞累、轉動及用力握持物體會加劇疼痛。還有，原告人的指間關節仍然僵硬，左手拇指不能屈曲，並且出現過敏情況。 雖然醫生認為原告人僅僅有能力恢復原先的工作，但是醫生也認為原告人用左手的拇指執行繁重、精巧細緻的工作會感到吃力，而工作效率會明顯下降。法庭接受原告人再不能用左手拿著批板，還有由於他的左手拇指不能承受振動，所以他不能用左手協助他使用機器，認為原告人無法重返意外之前的工作。原告人獲發共23個月的病假。就痛楚、痛苦、及失去生活樂趣賠償，原告人獲判HK$400,000；

(b)  Chung Tat Ho v Au Hoi Lam Sub-Contractor Ltd and another, HCPI 472/2003 (2004年9月6日)：原告 人是一名建築工地的模板工人，他操作的手持旋轉鋸滑落，割傷了左手食指和中指，導致其受傷。 其左手食指嚴重受傷，最後需要從近節指骨以上截割。原告人中指撕裂，但已完全康復。截肢前，原告人接受了大量治療。他患有左手食指剩餘骨骼的骨質疏鬆症，這導致不適和殘留疼痛，使他難以重返事故前的工作崗位，因為工作需要搬運重物，並且需要強壯且無痛的左手。他日後適合從事強度較低的建築工作或其他普通體力勞動。就痛楚、痛苦、及失去生活樂趣賠償，原告人獲判HK350,000；

(c)  Au Hon Ling v Ching Hoi Keung t/a C&L Co and another, HCPI 416/2003 (2004年9月1日)：原告人是一名從事裝修工程的木匠，在使用電動圓鋸時左手受傷。他的拇指至尾指被切斷，左手拇指幾乎完全截肢。他接受了左手拇指指間關節融合手術、橈指動脈血管重建手術、橈指神經修復手術和尾指指甲床修復手術。由於左手失去知覺，他接受了另外兩次手術。他亦接受了職業治療和超過34次物理治療，左手戴手夾板數月。他的神經移植供體部位的神經遠端出現神經瘤，亦已切除。他獲發病假接近兩年。 最終，原告人情況穩定， 但是進一步治療不太可能有效。 他的全身損傷被定為14%。 雖然他可能無法完全勝任木工工作，但應該能夠完成各種操作，儘管速度和效率會降低。就痛楚、痛苦、及失去生活樂趣賠償，原告人獲判HK$400,000。

39.  本席同意原告人所指，本案的情況比Xia Yunbiao更加嚴重。 本席認為本案的情況跟Chung Tat Ho及Au Hon Ling相若。經考慮上述案例， 包括該些判決的日期及年份，本席認為就痛楚、痛苦、及失去生活樂趣賠償，合理賠償金額應為 HK$500,000。

審前收入損失

40.  意外發生前，原告人於將軍澳明德商場就職為保安員，月薪為HK$9,014.00[2]。

41.  醫院一共發了265天病假給原告人（由2018年2月17日至2018年11月8日）。 因此，原告人應獲得HK$82,740的賠償：

HK$9,014 x (8+23/31) x 1.05 = HK$82,740

審後收入損失

42.  原告人在病假後返回了她意外前的工作崗位，因此原告人不作對於審後收入損失的申索。

賺取收入的能力損失賠償

43.  在Moeliker v Reyrolle & Co Ltd [1977] 1 WLR 132，第142頁，英國上訴法院指出，在處理失去賺取收入的能力這項申索時，若申索人在案件審訊時依然在職，法庭需考慮申索人會在退休前失去目前的工作而需投入就業市場的風險。

44.  就這方面，原告人依賴她現在還有的後遺症來支持她這項申索。原告人亦依賴她證供中提到的以下情況：

(a)  於工作期間需要搬運重物時，原告人的雙手及肩膊都會感到十分痛楚。在搬運重物後， 痛楚依然殘留直至晚間睡覺時仍未消散，使原告人難以入睡，不能好好地休息；

(b)  這份工作吃力的部份是於巡邏時，原告人需要經常推動玻璃門及木門。由於玻璃門及木門的體積大及重量不輕， 原告人雙手因而會感到痛楚；

(c)  原告人亦需要時常手提著「OB」簿，而OB簿的面積大約為A4紙的呎吋及厚度約1吋的厚紙皮封面簿。特別是在繁忙時間，原告人須一邊不斷地登記穿梭巴士的資料及一邊維持現場秩序， 這樣對於原告人受傷的雙手的負擔十分大。

45.  本席接受原告人這方面的證供及陳述。原告人現在是69歲，並且仍在工作，現職為保安員。假設她會在75歲退休， 本席接納原告人所指，認為這項申索應為原告人6個月的工資，即：

HK$9,014 x 6 = HK$54,084

醫療費用、車費及補品

46.  原告人追討醫療費用共HK$14,497，這些均是向公立醫院求診132次的費用。

47.  另外，原告人追討車費共HK$5,000。雖然原告人沒有呈交有關收據，但由於原告人來回醫院共132次，基於她所受的傷勢及後遺症， 本席認為她所申索的平均每次來回HK$38也為合理。另外，原告人追討HK$5,000的補品費用。本席亦認為此為合理金額。

判決

48.  基於上述原因，本席裁定原告人勝訴，並可獲得以下賠償：

49.  本席作出以下命令：

(1)  被告人須向原告人賠償HK$661,321.00 以及利息；

(2)  利息方面， 上述普通損害賠償的利息以年利率2%計算，由傳訊令狀日期，即2021年2月1日起計至判決日為止， 而上述專項損害賠償的利息則以判定利率的一半計算，由意外發生日期，即2018年2月17日起計至判決日為止。 另外，判決日後的利息以判定利率計算。

50.  本席亦作出命令，被告人須支付原告人的訟費（包括審訊的大律師證書）。若雙方未能協定金額，則由法庭評定，而原告人之訟費則根據《法律援助規則》(第91A章)評定。
