NOTIFICATION of the Judge’s decision (Ord. 53 r. 3)
Following;
Order by Deputy High Court Judge K.W. Lung:
Leave to apply for Judicial Review be dismissed.
Observations for the Applicant:
1. The applicant applies for leave to apply for judicial review of the Decision dated 9 July 2018 of the Torture Claims Appeal Board/Non-refoulement Claims Petition Office dismissing the applicant’s appeal against the Director’s Decision as described below (“the Board’s Decision”).
2. The applicant did not ask for a hearing. Pursuant to Order 53, rule 3(3) of the Rules of the High Court, I shall deal with his application on paper.
3. Upon enquiry with the Registry, this application overlaps another action HCAL 1386 of 2018, which the Court had dismissed for having no merits. Form CALL-1 was issued on 31 March 2021.
4. The Court of Appeal in Fabio Arlyn Timogan, Salaudin Rabia & Salaudin Faheem v Evan Ruth, Esq, Adjudicator of the Torture Claims Appeal Board/Non-refoulement Claims Petition Office [2020] HKCA 971, Hon Lam, Barma and Au JJA, 27 November 2020, held
“25. In Khan Kamran v Torture Claims Appeal Board, [2020] HKCA 380, the Court of Appeal held that it is an abuse of process for an Applicant to file a second application seeking judicial review in respect of the same Board decision and it was a breach of the duty of full and frank disclosure to make such application without stating that there had been a previous unsuccessful application for leave for judicial review of the same decision. Such application is liable to be struck out. It was further held that it would be appropriate to strike out an appeal against such decision as an abuse of process in such circumstances.”
5. The applicant has also written to this Court to express his apology for his duplicated application.
6. In the circumstances, I dismiss this application.

c) supply to every other party copies of every affidavit which the Applicant proposes to use at the hearing, including the affidavit in support of the application for leave (Order 53, rule 6(5)).
