DECISION ON COSTS

1.  This is my decision on costs.

2.  In the statement of costs for summary assessment dated 28 April 2016, a total sum of $29,485 is stated to be the plaintiff’s costs of the application for leave to appeal before me.

3.  I have not received any response from the 1^st defendant’s solicitors to the plaintiff’s statement of costs in spite of my direction and even after my clerk has reminded them by telephone.  Nevertheless, I shall proceed to summarily assess the costs.

4.  I allow the following amounts of $110, $3,950, $6,187.50 and $18,000 respectively for Items B (manual work), C (communications), D (professional work) and E (counsel).

5.  I have reduced Item D1 by 0.5 hr and Item D2 by 0.25 hour (total HK$1,237.50) for reasons of being excessive.

6.  On a nisi basis, therefore, I summarily assess the costs payable to the plaintiff by the 1^st defendant in the sum of $28,247.50.
