COURT: The defendant has pleaded guilty to one count of trafficking in a dangerous drug, contrary to section 4 of the Dangerous Drugs Ordinance.
In the evening on 17 February 2023, the defendant was intercepted by police officers at one staircase inside Mirador Mansion, Tsim Sha Tsui. On a bag that the defendant was carrying, various dangerous drugs and drug paraphernalia were seized.
Under caution, the defendant told police officers that he was instructed to deliver drugs in question to Jordan for financial reward. The dangerous drugs seized were 99.5 grammes of ketamine, 40.4 grammes of cocaine, 118.3 grammes of methylendioxymethamphetamine, in short ‘Ecstasy’, and 0.23 grammes of methamphetamine hydrochloride.
The street value was estimated to be over HK$180,000.
The defendant is now 45, a Form 8 holder. He has three conviction records, none relating to dangerous drug. It is accepted by the parties that the overall starting point in
this case, based on the quantity of the dangerous drugs, should be one of 9 years 2 months. An extra one year should also be added to reflect his immigration status.
The only mitigating factor in this case is his earliest plea in the Magistrates’ Court. As such, the defendant will be given the full one-third discount for that.
For the sole offence the defendant stands convicted, he is therefore sentenced to 6 years and 9 months’ imprisonment.
