COURT: The defendant has pleaded guilty to one count of trafficking in a dangerous drug contrary to section 4 of the Dangerous Drugs Ordinance in the Magistrates’ Court. He is committed to this court for sentence.
In the evening on 5 November 2022, the defendant was intercepted by police officers at a checkpoint. A body search was conducted, 12.6 grammes of methamphetamine was found concealed under his underpants. In addition, over HK$37,000 was also seized.
The street value was estimated to be over HK$7,000.
The defendant is 53, educated up to Form 1 level. He has 14 criminal convictions with multiple possession of dangerous drugs offences. Given the defendant’s multiple dangerous drugs offence past records, a starting point of 7 years and 3 months will be adopted.
In the absence of any evidence pointing to otherwise, the defendant will be treated as a simple courier in the present case. A full one-third discount will be given for his earliest plea.
For the sole offence the defendant stands convicted, he is therefore sentenced to 58 months’ imprisonment.
