判 決 書

引言

1.  本席於2021年6月18日就本案頒下判案書（「判案書」），判申請人勝訴，指令答辯人對金慶樓的排水系統進行調查和維修，並支付424,350元以賠償申請人的租金損失。本席亦頒下暫准訟費命令指令答辯人支付申請人此訴訟的訟費，若雙方未能協定金額則交回法院評定。

2.  答辯人於2021年7月2日以傳票方式申請更改上述暫准訟費命令，主張申請人只應獲得30%（或審裁處認為適合的份額）的部份訟費。雙方同意此申請以書面而無須聆訊的方式處理。答辯人和申請人分別於2021年7月20日及2021年8月17日提交書面陳詞。

3.  本席現就答辯人的更改暫准訟費命令之申請頒佈書面判決。

答辯人要求更改暫准訟費命令的理由

4.  答辯人指出，截至開審前，除了下述第 (4) 項之緊急通渠費用外，申請人堅持申索以下之項目：

(1)	賠償予租客「中國醫館」的損失：39,342元
(2)	「中國醫館」要求申請人賠償其裝修的費用： 650,894元
(3)	租金收入損失2,494,000元，當中包括：
	(a)	2014年12月至2017年7月：1,264,000元
	(b)	2017年8月之後的市值租金收入：180,000元+ 1,050,000元
(4)	緊急通渠費用：20,200元

5.  就上述第 (1) 和 (2) 項的申索（金額690,236元），審裁處接納答辯人的陳詞並裁定答辯人無須就此作出賠償[1]。

6.  就上述第 (3) 項的申索（金額2,494,000元）中的 (a) 項（金額1,264,000元），審裁處裁定申請人未能證明損失與答辯人有關，因此答辯人無須負責[2]。就 (b) 項（金額1,230,000元），審裁處裁定申請人沒有減低損失並評估有關時段的合理租金損失為424,350元[3]。

7.  就上述第 (4) 項的申索，雙方在開審時確認答辯人在調解之後已經支付申請人相關費用，因此申請人撤回此項申索。

8.  答辯人認為，申請人在損害賠償的申索部份失敗，很大程度上是由於申請人未能證明「中國醫館」終止合約的真正原因，以及沒有採取合理的措施或行動減低其租金損失。答辯人認為，以上皆為申請人作出損害賠償申索的基本要求。申請人的舉證責任清晰，卻從一開始就提交極少證據顯示「中國醫館」終止租約的原因，而就減低各項損失方面亦幾近沒有提供任何證據。在缺乏證據下仍然堅持上述申索項目屬於不合理的爭辯。

9.  答辯人又指出在審訊中答辯人的大律師有不少盤問是圍繞損害賠償的問題。據答辯人估計，大律師盤問申請人的證人（尤其是昝妙兒小姐）有超過一半的時間都是關於申請人失敗的申索項目。

10.  答辯人認為即使申請人成功確立答辯人的責任，若果得不到全部或大部份的濟助，申請人仍然不應被視作為完全成功的一方。從賠償金額來看，審裁處最後裁定申請人獲得424,350元，佔申請人要求的賠償金額的13.3%，這是重要的考慮因素。其他考慮因素包括申請人成功得到禁制令以及在其他爭論點成功、該些爭議點佔用的準備功夫和審訊時間、申請人誇張申索以及審訊的總體結果等。考慮了所有因素，答辯人認為申請人只應獲得此訴訟30%（或審裁處認為適合的份額）的訟費。

法律原則

11.  《高等法院規則》第62號命令第3 (1) 至 (2) 條指出：

「(1)	除本命令的條文另有規定外，任何法律程序的一方，除非是根據法庭命令，否則無權向該等法律程序的任何另一方，追討該等法律程序的任何訟費或附帶費用。
(2)	如行使其酌情決定權的法庭，認為適合就任何法律程序(非正審法律程序除外)的訟費或附帶費用作出任何命令，則除本命令另有規定外，法庭須命令該等訟費須視乎訴訟結果而定，但如法庭覺得就有關案件的情況而言，應就該等訟費的全部或任何部分另作命令，則屬例外。」

12.  《高等法院規則》第62號命令第5 (1) 條指出：

「(1)	法庭就訟費行使其酌情決定權時，須在有關情況下屬於恰當的範圍(如有的話)內，考慮 —
	(aa)	第1A號命令第1條規則列出的基本目標； … …
	(e)	各方的行為舉措；
	(f)	某一方是否已在其案件中局部勝訴(即使他並未全盤勝訴)；及
(2)	就第(1)(e)款而言，各方的行為舉措包括 —
	(a)	某一方提出或持續某特定指稱或爭論點，或對某特定指稱或爭論點提出爭議，是否屬合理；
	(b)	某一方持續其案件或某特定指稱或爭論點或對之作出抗辯的方式；
	(c)	在申索中全盤或局部勝訴的申索人有否誇大其申索；及
	(d)	在法律程序展開前以及法律程序進行中的行為舉措。」

13.  《土地審裁處條例》第12條規定如下：

「(1)	在審裁處進行的所有法律程序的訟費及附帶訟費均由審裁處酌情決定，審裁處並有一切權力決定誰人須支付該等訟費以及須支付的範圍。
(2)	在不損害第 (1) 款的一般性的原則下，如審裁處信納作出命令，判並非有關法律程序一方的人支付訟費屬秉行公正，則審裁處可如此作出命令。 … …
(5)	凡審裁處根據第 (1)、(2) 或 (3) 款就訟費作出裁斷，審裁處可命令該等訟費按照下述規則評定 –
	(a)	《高等法院規則》(第4章，附屬法例A) 第62號命令附表1及附表2；或
	(b)	《區域法院規則》(第336章，附屬法例H) 第62號命令附表1及附表2。」

14.   法律典籍Hong Kong Civil Procedure 2021 (Vol. 1)於第1278頁，第62/3/3段有以下意見：

“A successful plaintiff who recovers more than nominal damages against the defendant should in normal circumstances have an order for costs against the defendant...”

15.   有關於訟費的法律原則，Nourse LJ 於 Re Elgindata Ltd (No 2)[4]判詞中第1214頁第A至C行有以下說法：

“The principles are these:  (i) Costs are in the discretion of the court.  (ii) They should follow the event, except when it appears to the court that in the circumstances of the case some other order should be made.  (iii) The general rule does not cease to apply simply because the successful party raises issues or makes allegations on which he fails, but where that has caused a significant increase in the length or cost of the proceedings he may be deprived of the whole or a part of his costs.  (iv) Where the successful party raises issues or makes allegations improperly or unreasonably, the court may not only deprive him of his costs but may order him to pay the whole or a part of the unsuccessful party’s costs.”

16.   Lord Carswell 於Seepersad v Persad and Another [5]的判詞第24段進一步解釋Nourse LJ 於 Re Elgindata Ltd (No 2)所訂立的法律原則：

“The general rule which should be observed unless there is sufficient reason to the contrary is that costs will follow the event.  Where the party who has been successful overall has failed on one or more issues, particularly where consideration of those issues has occupied a material amount of hearing time or otherwise led to the incurring of significant expense, the court may in its discretion order a reduction in the award of costs to him, either by a separate assessment of costs attributable to that issue or, as is now preferred, making a percentage reduction in the award of costs …  The Court of Appeal’s order was predicated upon the proposition that the assessment of damages for pain and suffering and loss of amenity was a separate issue from the assessment of the other heads of damage.  This was an incorrect assumption.  An issue for these purposes must be something so distinct and separate in itself that the decision of it constitutes an ‘event’.  The ‘event’ was the quantum of damages to which the appellant was entitled and he succeeded on his appeal in obtaining a higher award than Lucky J had given …  The Board accordingly consider that the Court of Appeal had insufficient ground for reducing the award of costs made to the appellant and that he should have been awarded full costs in that court ...”

17.   時任高等法院原訟法庭林文瀚法官於Hong Kong Kam Lan Koon Ltd v Realray Investment Ltd (No.4)[6]的判詞中援引了上述Lord Carswell於Seepersad v Persad and Another的段落，並於其判詞的第14段有以下討論：

“One therefore starts with the premise that a successful party is prima facie entitled to the full costs of the action.  The burden is on the losing party to show that there is good reason to depart from the general rule.  The exercise is a matter of discretion. It would be wrong to read Elgindata as laying down that as a rule, the court must (instead of may) deprive a successful litigant of costs for his failure on a discrete issue which caused a significant increase in costs.  The court has to exercise its discretion to achieve a just result having regard to the circumstances of the case.”

18.   時任高等法院首席法官鄧楨法官於Kwan Siu Wa Becky v Cathay Pacific Airways Ltd[7]一案的判詞第9段援引和確認了上述林文瀚法官於Hong Kong Kam Lan Koon Ltd v Realray Investment Ltd (No.4) 中的看法。

19.   時任香港終審法院常任法官包致金於CIR v HIT Finance [8]於判詞中第7段有以下觀察：

“There is a discretion in the court to deprive a successful party of the whole or part of his costs because he had caused a significant increase in the length or costs of the proceedings by raising issues on which he did not succeed.  That can be done even if it was not unreasonable to have raised those issues.  Whether or not it should be done depends on all the circumstances.  This discretion exists for the purpose of avoiding the rigour of too inflexible an application of the rule that costs generally follow the event.  It is to be approached with due circumspection so as not to undermine the utility of that general rule…”

20.   終審法院於Pony HK World v Vand Petro-Chemicals (BVI) Co Ltd [9] 一案的判詞第4段引用上述CIR v HIT Finance就訟費的觀察，並指出法庭在決定偏離一般訟費原則時須小心處理，以防止該訟費原則的有效性被減弱。終審法院指出假若法庭太容易偏離一般的訟費原則，會引致無謂爭拗，以致增加訟費。

21.   時任香港終審法院非常任法官包致金於Mariner International Hotels Ltd v Atlas Ltd (No 2)[10]一案的判詞第18段指出，主張「訟費應視乎訴訟結果而定」的原則不適用的一方，有責任證明存在著特殊情況以支持偏離該一般原則。

討論

22.   申請人認為它方在責任方面勝訴並獲得禁制令，在這個前題下審裁處的訟費命令充分跟隨了《高等法院規則》第62號命令第3(2) 條「訟費應視乎訴訟結果而定」的原則。根據上述終審法院的案例，法庭於考慮是否該偏離該訟費原則時須謹慎處理，以避免減弱該訟費原則的有效性和引致無謂的爭拗。

23.   申請人又認為，答辯人作為申請更改暫准令的一方，未能按照Mariner International Hotels Ltd v Atlas Ltd (No 2) 履行其責任證明此案存在著特殊情況以支持偏離該原則。特別是答辯人未能證明申請人有下述兩方面的行為舉措不恰當：

(1)	提出多項不為法院接納的爭議以致大幅增加審訊時間及訟費；及
(2)	蓄意地誇大其申索金額。

24.   就爭議點而言，正如代表申請人的楊明悌大律師指出，以下的主要爭議事項是經雙方同意和提出的：

(1)	答辯人是否須為涉案物業出現污水倒灌或穢物湧出負上法律責任?
(2)	如是，答辯人是否已經採取合理補救措施?
(3)	答辯人能否減少申請人指稱遭受的損失?
(4)	申請人曾否不合理地佔用涉案物業的天井及/或拒絕及/或未有積極配合讓答辯人進入該物業就污水倒灌或穢物湧出事件進行跟進及/或補救措施?
(5)	如答辯人須要負責，申請人可獲得甚麼濟助？
(6)	申請人是否有採取任何措施去減低其聲稱的租金損失?

25.   就爭議事項 (1) 至 (4) ，本席在正審後裁定申請人勝訴[11]。

26.   爭議事項 (5) 及 (6) 有相互的關聯性，因此應該一併考慮。就這兩個爭議事項而言，本席在正審後頒佈強制性禁制令指令答辯人在4個月內對排水系統進行所有合理和必要的調查和維修[12]。雖然本席裁定答辯人無須賠償申請人有關其租客「中國醫館」的損失或補償，答辯人仍須就申請人本身蒙受的租金損失作一定的賠償。

27.   本席認為有關「中國醫館」的損失只是關於「濟助」此範疇以下的「損害賠償」中的其中一個支項爭議點，這個支項爭議點並非獨立的爭議事項，審裁處就這支項爭議點的裁決並不構成一個「事件」 (“event”) 。因此，根據Lord Carswell於Seepersad所訂立的法律原則，審裁處不應因為在此支項爭議中不認同申請人而扣減申請人的訟費。

28.   就申請人的租金損失而言，本席雖然沒有批准申請人全數的申索金額，但經評定後仍命令答辯人須支付予申請人損害賠償424,350元連同利息。本席未有接納申請人的全數申索原因主要有二。首先，就2014年12月1日至2017年7月31日此時段的租金損失，本席認為申請人未能提供足夠的證據去讓審裁處判斷在申請人與「中國醫館」的租約中雙方的法律責任而確立有關的租金損失[13]。另外，2017年8月至2019年8月的租金損失，本席認為申請人沒有採取合理的措施或行動以減低其租金損失，本席因此評估合理的租金損失為424,350元[14]。

29.   同樣地，租金損失只是「濟助」此範疇中的「損害賠償」以下的子項爭議點而並非獨立的爭議事項，審裁處就這子項爭議點的裁決並不構成一個「事件」 (“event”) 。因此，本席認為根據Lord Carswell於Seepersad 所訂立的法律原則，審裁處不應因在此支項爭議中不認同申請人而扣減申請人的訟費。

30.   有關減低損失的問題，時任高等法院上訴法庭法官羅傑志副庭長於Ho Lai Chuen v Xerox (Hong Kong) Ltd [15]一案的判案書中的第6段有以下的討論：

“… In the first place, if a plaintiff makes a claim which is disputed on liability as well as quantum and recovers, it is, generally, entitled to its costs, save insofar as it may be found at fault for having increased those costs unnecessarily…

In the second place, the deputy judge appears to have made his order on the basis that the plaintiff failed to adduce evidence which, in effect, related to mitigation.  A plaintiff is entitled to claim the amount which it says it had lost as a result of a contract not being performed and any matter of mitigation of that amount is a matter of defence.  It is clearly established in such cases as Roper v Johnson (1873) L.R. 8 C.P. 167, see especially 184, and Garnac Grain Co. v Faure and Fairclough [1968] AC 1130 at 1140 that mitigation is a question of fact.  There was thus no basis put forward for depriving the plaintiff of part of his costs. Liability was disputed to the end…

Any factors in mitigation of damage were for the defendant to plead and prove.”

31.   本席同意申請人的說法，申請人有否採取任何措施去減低其租金損失是答辯人的辯護理由，並須由答辯人提出申辯。申請人有權要求答辯人賠償其聲稱的損失。即使答辯人成功證明申請人沒有採取任何措施去減低其租金損失，審裁處亦不應為此而扣減申請人的訟費。

32.   答辯人於其書面陳詞的第16段指出申請人的事實證人昝妙兒小姐的盤問佔去審訊的一定時間，似是暗示審訊因為咎小姐的作供而拉長。昝小姐和鄒潤雄先生是申請人的關鍵證人，他們的證供不單與租金損失有關，更是對答辯人是否須要為倒灌一事負上法律責任有莫大的關係。申請人的兩名證人作供的時間，只佔大概4個多小時，沒有大幅增加審訊時間，而事實上整件案件亦能在原訂的3天內完成開案及證供部份。

33.   總括而言，申請人乃整宗案件勝訴的一方。即使將每個爭議事項分拆來看，申請人亦於爭議事項 (1) 至 (4) （即責任問題）完全成功，並於爭議事項 (5) （即關於濟助及賠償）中部份成功。本席認為，答辯人未能證明申請人提出多項不為審裁處接納的爭議以致審訊時間及訟費大幅增加。

有否蓄意地誇大其申索金額

34.   雖然申請人未能成功獲得全數的申索金額，但這並不代表申請人蓄意地誇大其申索金額。事實上，本席只是不認為申請人提交的證據足以支持整個申索金額，沒有質疑申請人蓄意地、嚴重地誇大其損失。

結論

35.   總括而言，正如時任高等法院原訟法庭林文瀚法官於Hong Kong Kam Lan Koon Ltd v Realray Investment Ltd (No.4) 的判詞中所說：

“It would be wrong to read Elgindata as laying down that as a rule, the court must (instead of may) deprive a successful litigant of costs for his failure on a discrete issue which caused a significant increase in costs...”

36.   即使審裁處認為應行使其酌情權，根據爭論議題的結果（使用 “issue-based approach”）去評定訟費，考慮了上文的討論，本席認為 (1) 申請人能成功證明其訴因中的每個要素；(2) 未能完全成功的事項（「中國醫館」的損失及不能全數取得租金損失）並非獨立的議題或事件而是某議題下的支項爭論點及 (3) 答辯人作為申請更改暫准令的一方，未能按照Mariner International Hotels Ltd v Atlas Ltd (No 2) 履行其責任證明此案存在著特殊情況以支持偏離該「訟費應視乎訴訟結果而定」的原則。

37.   基於以上分析，本席現頒令：

(1)	答辯人日期為2021年7月2日的更改暫准訟費命令的申請被撤銷；
(2)	日期為2021年6月18日的暫准訟費命令成為絕對命令；及
(3)	答辯人須支付申請人更改暫准訟費命令申請之訟費，連同大律師證書，如雙方未能協定訟費金額，則由法庭依區域法院基準作評定。
