1.  引言

1.1  屯景別墅 (屯門新界丈量約份編號 131 地段編號 630)，由原大業主於1980年代初發展，興建前後兩排合共16座兩層高的村屋，每排共 8 座樓宇 (“該屋苑”)。 該屋苑的公契於1984年 4月14 日註冊，註冊摘要編號為TM242691 (“該公契”)。

1.2  申請人 (“A”) 分別於 90 年代初及中期成為該屋苑第 8 座地下 Al 室及 A 室單位的業主 (“A 物業”)。

1.3  第一及第二答辯人 (“R”) 於2010年購入該屋苑第8座的1樓 A室及Al室及1樓A室及A1室之天台 (“R 物業”)。

1.4  A 認為從 2010 年的轉易契及其附表顯示，R於2010年購買的業權之專屬享用部份為一份註冊摘要編號為 TM270341 的轉易契之附件中的 1^st Floor Plan及 Roof Plan 中的粉紅色部份，並沒有顯示R專屬享用的業權包括第8座天台 Roof Plan的白色部份 (即：天台的所有外牆、南北兩面的斜身瓦頂外牆、天台西北角原水箱部份、及天台梯房連接西面外牆的牆壁) 及第8座的地下一層及其牆壁 (不論內外牆)。

1.5  不爭的事實為，於 2016至2017 年間，R委託工程人員在R物業作出加建及改建工程 (“該工程”)。

1.6  根據A 在其再修訂申請通知書 (“NOA”) 闡述的案情， A 認為該工程涉及以下違反該公契的作為：

(1) 沿天台外牆上加蓋及豎立可密封及有上蓋的構築物，更侵佔天台西北角連接天台外牆原屬樓宇公用部份的原水箱空間及/或改變該空間與梯房的外牆和間隔，將整個天台 (包括:非其專屬享用部分)變成其居所;

(2) 將天台前後兩幅有排雨水功能的斜身瓦頂外牆拆走，然後換上直身外牆及作為天台露台和其天台出入口，以佔用原斜身瓦頂外牆的位置，使天台內部空間向外擴大，亦使樓宇外牆在短短的數年間出現多處水痕及/或大片油漆脫落;

(3) 在 1 樓 A 室之露台的外牆上加建窗戶，使露台圍封變成室內居所;

(4) 把1樓單位於地下的出入口上方的一幅斜身瓦頂外牆拆走，並沿地下外牆加建有上蓋的構築物，將屬於8座各單位安置在該出人口上的外牆 (原有斜身瓦頂下) 之電錶完全圍封;

(5) 按其加建及擴大居所需要而在8座外牆上 (尤其是在天台的外牆上) 加裝及改動大量來去水喉之設施和渠管;

(6) 在該工程進行期間，R未能防止泥頭及/或外牆碎塊落下在樓宇外行人/車路上。連地下單位外牆窗邊上至今也留有不少由該工程時掉落的石屎/乾涸的英泥/英泥水/混凝土。

1.7  NOA 第9A段要求法庭作出11項強制命令：

(1) 清拆天台所有加建的不合法的構築物 (包括但不限於門、窗戶、窗框、間隔牆、頂蓋、支架、渠管及/ 或水管、電線及/或電線管)；

(2) 清拆天台外牆上的所有僭建物 (包括不限於來去水管、電線/電線管、冷氣機、木欄)；

(3) 清拆天台高於原有外牆高度以上所有石屎部份 (原有梯房未作改動的部份除外) 及構築物；

(4) 還原天台北面及南面外牆具排雨功能的斜向下之瓦頂外牆；

(5) 還原天台西北面屬已被佔用的公用部份空間及/或空間與梯房的間隔及/或該部份被拆卸的牆壁及外牆；

(6) 清拆1樓A室 (即南面) 露台外牆的窗戶、窗框及其他僭建物 (如有)；

(7) 清拆其通往一樓樓梯在地下門口外牆的所有圍封物 (兩幅白色混凝土矮牆除外)；

(8) 還原通往一樓樓梯在地下門口外牆上 (即涉案樓宇三個電錶對上之外牆位置) 具排雨功能的斜向下的瓦頂外牆；

(9) 清拆東面地下外牆上新裝圍繞其新裝水管及潛在新水錶位置的大金屬架[1]；

(10) 清除樓宇附在地下外牆的渠管上屬該工程期間所遺留的石屎及工程物料，並更換或維修該些渠管；

(11) 清除樓宇地下單位外牆窗邊上述該工程期間所遺留的石屎及/或其他工程物料，並維修該部份外牆。

1.8  NOA 第9B 段要求法庭作出命令，規定R 在進行NOA 第9A 段工程時：

(1) 其工程的影響範圍只可局限於上述指明需進行清拆及還原工程的樓宇位置及其單位具專屬享用的部份；

(2) 所有物料 (包括但不限於工程物料、工程廢物、器具、傢俬、雜物/廢物等) 必須通往樓宇一樓單位及天台的樓梯進行轉移和搬運，不得在外牆和窗戶以搭建臨時滑梯的方式及/或其他危險的方式掉棄/傾倒任何物料 (包括但不限於工程物料、工程廢物、其他相關器具、傢俬、和雜物/廢物等)；

(3) 上述工程只能在星期一至五上午 9:00 至下午 5:00 的時段內進行，以防止噪音及其他滋擾。

1.9  NOA 第9C 段要求法庭作出禁制令，禁止R 在涉案建築物再次建設或維修任何違規或不合法的僭建物/構築物/渠管/結構。

1.10  在本案中，R 在其經修訂反對通知書的濟助部份 (“Form 7 ” ) 作出一系列反申索。在結案陳詞階段，R放棄數項申請。R 繼續追討以下5 項申請：

(1) 拆除A 物業前的大型平台構築物 (“反申索一”)；

(2) 不得拒絕開放其門口平台構築物，讓搭棚及拆除工程順利進行 (“反申索二”)；

(3) 拆除A物業北面牆身的大型簷篷及簷篷頂上的金屬蓋片，並且清除公用外牆身上的英泥及還原/或修補因此而受損壞的公用外牆 (“反申索三”)；

(4) 拆除A物業南面公用外牆的大型鐵閘，並修補因此而受損壞的公用外牆 (“反申索四”)；

(5) 拆除A 物業西面公用外牆身的金屬曬衣架/金屬支架簷篷， 清除公用外牆身上的英泥並修補因此而損壞的公用部份 (“反申索五”)。

1.11  反申索二顯示，R 的立場是願意進行某些拆除工程。 由於雙方並沒有共識， 本席必須就NOA 第9A 段的申索作出裁決。

1.12  在審訊中A 由其兒子關智威先生 (“關先生”) 代表，關先生和A亦在審訊過程中作供。關先生是該屋苑第7座地下A1室 (“7GFA1 室”) 的業主。關先生的爸爸 (“關老先生”) 於1990年購入7GFA1室，而關先生於2022年繼承該物業。A 與關老先生於1990年結成夫婦，並於1998年離婚。關老先生於2021年離世。

1.13  R 則傳召第一答辯人作供。

2.  相關背景

2.1  在本部份，本席會就相關背景作出事實裁決。除非另有說明， 以下的事項是不爭或不能爭議的事實。

2.2  對處理證據上的衝突，Lee Fu Wing v Yan Paul Po Ting [2009] 5 HKLRD 513 (第53段) 及Kwan Shuk Ching v Wan Mei Yau [2022] HKCFI 3781 (第 9至12 段) 指出以下的因素應當考慮：

(1) 固有可能性 (inherent probabilities)；

(2) 是否與當期文件或不可否定的證據兼容 (consistency with contemporaneous or indisputable/undisputed evidence)；

(3) 證人口供是否可信 (witness credibility)；及

(4) 證人神態舉止 (demeanour)。

2.3  該屋苑自1985年11月建成及入伙以來，並沒有成立業主立案法團及舉行業主大會， 亦沒有業主委員會。

2.4  關先生自九零年代初居住於A 物業。A與關老先生離婚後搬離A物業 (大約1999年)，但每月會到訪A 物業數次探望關先生。

2.5  關於反申索一及三提及的平台構築物 [41及130] [2] (“該平台”) 及大型簷篷及簷篷頂上的金屬蓋片 [42] (“該簷篷”)， 從呈堂的相片中可得悉，自從九零年代已存在。 在呈堂的相片 [41] 中亦能清楚看見， 由於第八座是建築於一斜坡， 若果將該平台拆除，明顯會令到A 物業的佔用人或A進出A 物業造成極大不便。

2.6  本席同意A的立場。R於2010年購買的業權之專屬享用的部份為一份註冊摘要編號為 TM270341 的轉易契之附件中的 1^st Floor Plan及 Roof Plan 中的粉紅色部份，並沒有顯示R專屬享用的業權包括第8座天台 Roof Plan的白色部份及第8座的地下一層及其牆壁 [108-109]：見上文第1.4段。

2.7  本席亦同意A 的另一立場，從文件證據顯示，該屋苑的原有建築外觀沒有任何頂蓋/簷篷等構築物 [183-184] (“原外觀”) 。

2.8  但本席接納R 的證供。該屋苑的原外觀已經歷重大轉變。呈堂的照片顯示該屋苑每一座均已建有頂蓋 [65, 178-179, 270]， 而各座天台亦不同程度被圍封。

2.9  該工程於2016年中下旬至2017年上旬進行，並涉及上文第1.6(1) 至 (5) 段提及的工程。

2.10  A 供稱自從2016年10月一直有就該工程作出投訴，包括有關改建及加建和遺留石屎的問題。

2.11  R 並不同意A 的證供。在其Form 7 中，R 指出不論在該工程前或後，一直與A相安無事。本申請於2022年4月提出，事緣為A 和R 於2021年下半年至2022年上半年因該屋苑污水渠接駁事宜 (“污水渠事件”) 結怨。

2.12  基於以下原因，本席認為A 提出本申請明顯是由於污水渠事件導致雙方結怨：

(1) 本席不接納A 方的證供，即自2016年10月一直有就該工程作出投訴。

(2) 文件證據顯示，A 於2021年8月聘請律師向R發出投訴信。該投訴信的內容並不涉及於本申請要求法庭頒令的濟助，反而只是要求R 將雜物/植物/盆栽從第8座與第7座地下通道清走 [149] (“2021 投訴信”)。

(3) A 同意污水渠事件牽涉的工程於2022年2月24日完成。於2022年2月25日，A 向R 發出投訴信，首次在文件上就該工程作出投訴 [151] (“2022 投訴信”)。

(4) 在聆訊中，A 解釋 2021 投訴信並沒有就該工程作出投訴是因為A 仍在就該工程導致的後果作出觀察。

(5) 本席不接納A 的解釋。2022 投訴信的內容為：

“至2016年約10月起貴單位自行不斷進行天台加建及渠管改建工程，尤其將門口對上的本單位電表也圍封實屬滋擾。本人至今多次曾作出過口頭勸喻不果，現特此致函為閣下，貴單位的天台及正門的構築物及最近之渠管改動，均屬不合法建築工程，亦有違大廈公契也對本人構成滋擾，因此本人要求閣下在本信件發出後十天內拆除所有不合法的構築物/渠管及僭建物。如果閣下不遵從，本人在別無選擇思考，唯有向法庭申請強制命令及相關訴訟費用。”

(6) 很明顯，根據A 本身的案情，A在該工程完成後 (即2017年) 已就2022 投訴信的內容有充分了解[3]。本席看不到任何原因A需要就該工程作出4 至5年的觀察。

(7) 本席亦有留意到第7座的情況 [65]。 關老先生和關先生是7GFA1室的註冊業主，而第7座的天台已建有頂蓋給完全被圍封。在本案中，並沒有任何證據關先生或關老先生曾作出相應的投訴。

2.13  本申請中，R 是處於被動的位置。 R 在相關時段並不認為反申索一至五的事項需訴諸法庭。 本席接納R 的立場，即R 提出反申索主要基於R認為A 提出針對性的申請而作出的 ”反射動作”。

3.  訴因及相關法律原則

3.1  雙方的訴因皆基於違反該公契及《建築物管理條例》344章 (“該條例”) 第34I條。

3.2  R 並沒有具體指出其反申索是基於該公契哪一條條款。

3.3  A 則引用該公契第五條：

“[5] Each of the parties hereto for the time being of any undivided shares of and in the said land hereby covenants:-

[(c)] not to make any structural alterations to any part of the buildings erected in the said land of which the owner has the exclusive right and privileged to hold use occupy nor do or permit or suffer to be done anything thereon which would in any way alter the external appearance of the buildings erected on the said land and not to cut maim injure damage alter or interfere with any part or parts of the said land in common use of any of the sewers drains watercourses conduits pipes cable wiring fixtures equipment apparatus landscape or services of the said land.

[(f)] not to use or permit or suffer any part of the said land of which the owner has the exclusive right and privilege to hold use occupy and enjoy to be used for any illegal or immoral purposes nor to cause or permit or suffer to be done any act or thing in any such part which may be contrary to any Ordinance Regulation or by-law or to the terms and conditions on which the said land is held from the Crown or which may become a nuisance or annoyance to or cause damage to other owners and occupiers of the said land.

[(g)] not to erect or permit or suffer any structure to be erected on the Roof nor do permit or suffer to be any anything thereon which would in any way alter the external appearance of the buildings erected on the said land.

[(h)] to keep the premises of which the owner has the exclusive right to hold use occupy and enjoy in a good state of preservation and cleanliness and shall be responsible for ensuring that no dirt garbage or waste or other matter is dropped thrown or swept outside the same on to the common areas or on the premises of any other owner.”

3.4  該條例第34I條訂明：

“(1) 任何人不可 —

(a) 將建築物公用部分的任何部分改作自用，除非該項改變乃由業主委員會(如有的話)藉決議批准者；

(b) 使用或准許他人使用建築物公用部分的任何部分，以致 —

(i) 不合理地干擾建築物的任何業主或佔用人對該等部分的使用或享用；或

(ii) 對合法在建築物內的任何人造成滋擾或危險。

(2) 任何人違反第(1)款，即當作違反建築物公契對他施加的責任。”

3.5  該條例就公用部份有以下的定義：

“公用部分 (common parts) 指 —

(a) 建築物的全部，但不包括在土地註冊處註冊的文書所指明或指定專供某一業主使用、佔用或享用的部分；及

(b) 附表1 指明的部分，但上述文書如此指明或指定的部分除外；”

3.6  而附表1指公用部分包括：

“[1] 外牆及承重牆、地基、柱、樑及其他結構性支承物。

[4] 護牆、圍欄及邊界牆。

[6] 水箱、水池、水泵、水井、污水管、污水處理設施、排水渠、糞管、廢水管、溝渠、水道、雨水渠、導管、落水管、電纜、陰溝、垃圾槽、卸斗及垃圾房。”

3.7  至於該公契第5(c) 條提及的 “structural alteration”, 在 The Incorporated Owners of Elite Garden v Profit More Company Limited [2002] 2 HKLRD 518一案中，上訴庭就 ”結構性改動” 作出的詮釋。上訴法庭認為有關 ”結構性改動” 字眼最重要的字為 ”改動” (alteration)，而 “改動” 的意思，是包括改動有關型式 (form) 及結構 (structure)，上訴庭認為有關 ”結構性”(structural) 並非技術用詞，所以須以一個普通方式演繹有關字眼，即使不影響結構安全，這不代表沒有 ”結構性改動”。

3.8  在頒發強制令的問題上，法庭可以行使酌情權。 在The IO of Shan Kwon Towers Phase II v Li Sue Ching [2007] 4 HKLRD 567一案中，審裁處引用以下原則：

“[15] Even though I have found that Clause 10(a) of the DMC has been breached and the Respondent is responsible for that breach, I am however not prepared to grant the mandatory injunction sought by the Applicant. The court always has a wide discretion in granting or refusing a mandatory injunction. In Morris v. Redland Bricks Ltd. [1970] AC 652, Lord Upjohn of the House of Lords gave the following judgment:-

“The grant of a mandatory injunction is, of course, entirely discretionary and unlike a negative injunction can never be “as of course.” Every case must depend essentially upon its own particular circumstances. Any general principles for its application can only be laid down in the most general terms:

1. A mandatory injunction can only be granted where the plaintiff shows a very strong probability upon the facts that grave damage will accrue to him in the future….It is a jurisdiction to be exercised sparingly and with caution but in the proper case unhesitatingly.

2. Damages will not be a sufficient or adequate remedy if such damage does happen….

3. Unlike the case where a negative injunction is granted to prevent the continuance or recurrence of a wrongful act the question of the cost to the defendant to do works to prevent or lessen the likelihood of a future apprehended wrong must be an element to be taken into account…”

[16] From the above judgment, it is clear that in granting or refusing a mandatory injunction, the court has to consider the particular circumstances of the case and the jurisdiction should be exercised cautiously. It is necessary to consider that damages will not be a sufficient or adequate remedy, and the cost to the defendant to do works should also be taken into account. Further, in Sharp v. Harrison [1922] 1 Ch. 502 and Wong Sui Fung & anor. v. Yip Siu Keung LDBM 248 of 2000, it has been held that where no damage has been occasioned and the granting of a mandatory injunction would inflict damage on the defendant out of all proportion to the relief given to the plaintiff, the court ought to refuse it.”

3.9  正如阮光安v 悠然山莊業主立案法團 [2022] HKLdT 12 指出 (第115段)，相同的原則應用在Wilmes Lai Shim v Ng Jess, LDBM 266/2013, 3 December 2014。

3.10  在Wilmes一案中，法庭需要處理的事項，正如本案，是牽涉一村屋的兩名業主互相投訴對方違反公契 (包括佔用公用部份)。 在該案中，審裁處裁定雙方的投訴成立，但拒絕作出強制令：

“[61] The respective applicant in each cases is asking for a mandatory injunction for the structural alterations to be removed and the original state of that part of the Building to be reinstated.

[62] Even though I have found that both Wilmes and Sum had been in breach of the DMC, I am however not prepared to grant the mandatory injunction sought. The court always has a wide discretion in granting or refusing a mandatory injunction… [引用 Morris v Redland Bricks Ltd]…

[63] From the above judgment, it is clear that in granting or refusing a mandatory injunction the court has to consider the particular circumstances of the case and the jurisdiction should be exercised cautiously. It is necessary to consider that damages will not be a sufficient or adequate remedy, and the cost to the defendant to do works should also be taken into account.

…

[65] In the present case, there is no evidence to show that any grave damage is likely to be occasioned in future if the mandatory injunction is being refused. Nor is there any evidence to show that damages would not be sufficient remedy if such damages did arise. Not many people would be able to notice the breaking down of the external wall of the Building by Sum and the inconvenience caused to Sum in their access to the Antenna is minimal.

[66] On the other hand, if an injunction is being granted, both Wilmes and Sum have to incur expenses in the reinstatement of the external wall or the Roof. Even though there is no evidence to show as to how much this will be, the costs would not be cheap. The costs in the reinstatement work, when compared to the inconvenience and/or damages likely to be caused to the injured party may not be proportional.

[67] I found it unjust and inequitable to grant any mandatory injunction in both cases.”

3.11  根據《時效條例》347章第4條，就蓋印文據的訴訟之時效為 12年。

3.12  在以下部份，本席就A 和R 的申請作出分析及裁決。

4.  A的申請

NOA 第9A(1)-(8)段

4.1  正如上文第2.9 段所述，該工程涉及上文第1.6(1) 至 (5) 段提及的工程 [11-20]。 本席認為第8座天台的所有外牆、南北兩面的斜身瓦頂外牆、天台西北角原水箱部份、及天台梯房連接西面外牆的牆壁均為公用地方。

4.2  本席接納A 的案情。該工程違反該公契第5 (c) 及 (g) 條及該條例。本席特別指出，就上文第1.6(5) 段，R並沒有權在公用地方加裝來去水喉之設施和渠管：見Cheung Yuk Fung v Cheung Wau Yuen [2023] HKLdT 35第18-36段。

4.3  正如上文第2.8段所述，雖然本席接受R 的證供，即該屋苑的原外觀已經歷重大轉變，但本席不認為這事實足以成立抗辯理據。 在The Incorporated Owners of Hamilton Mansion v Yu Kien Chiu & Ors [1998] 1 HKLRD 62 一案中，答辯人指出如一物業的本質已經歷重大轉變，公契的契約可被視為不存在或沒有價值：

“To succeed on this ground of defence, the respondent must not only show that the object of the covenant cannot now be achieved because of the complete or substantial change in character of upper floors but also that such change has been brought about by the acts or omissions of the applicant….

The principle has been applied in a Hong Kong case : Lee Hysan Estate Company Limited V Sky Heart Limited No. A8239 of 1995. It is quite clear that the change of character of the upper floors in the building in the present case is not beyond the control of the applicant. No doubt it could have taken legal actions against some if not all flat owners guilty of breaches of the covenant. Therefore if it can be shown that the object of the covenant cannot be now be achieved, the respondents must succeed on this ground. In such case, the applicant would have been found acting not bona fide and guilty of being capricious in bringing these proceedings… ”

4.4  但本席必須指出，證明此抗辯原因有極大困難。正如Building Management in Hong Kong, 3rd edition 第5.404 段述明：

“This ground was recognised in Hong Kong in Lee Hysan Estate Company Ltd v Sky Heart Ltd but it is difficult to prove. The court will presume that the covenant continues to confer a benefit and it must be established that the change has been brought about by acts or omissions of the covenantee, the person for whose benefit the covenant exists. If the changes are beyond the control and independent action of the covenantee, the defence will not apply. This means in effect, that the defence will be virtually impossible to establish in multiple ownership cases because all the other owners, as covenantees, would have to be taken to have brought about the change. Not are rights lost simply because the manager is sympathetic, or because breaches may be tolerated for some time before action is taken.”

4.5  在本案中，並沒有足夠證據證明A可控制或自身導致該屋苑原外觀的改變。

4.6  縱使R違反該公契或該條例，在頒發強制令的問題上法庭可以行駛酌情權：上文第3.8 至 3.9 段。在本案中，A 認為該工程導致以下的滋擾或損害：

(1) 損害了A對建築物外觀、結構及公用部份所享有的共同利益；

(2) 由於三幅具排雨功能斜向下的瓦頂被拆卸，樓宇公用部份的外牆出現大片油漆脫落或污水痕影響樓宇外觀或公用部份外牆的維護。

4.7  基於以下原因，本席拒絕就NOA 第9A(1)-(8) 段頒布強制命令：

(1) 在本案中，並沒有充分證據證明沒有強制命令引致A 蒙受嚴重損失。即使A有機會蒙受損失，並沒有充分理由損害賠償不是一個充分或足夠的賠償。

(2) 該工程已於2017年上旬完工。 本席已在上文裁定本申請的源由是基於污水渠事件。在污水渠事件之前，A並沒有就該工程作出任何投訴。

(3) 在本案中，並沒有任何證據R 佔用公用地方導致A 蒙受任何實質不方便或損失。

(4) 至於A 指稱外牆出現大片油漆脫落或污水痕，本席有檢視呈堂的相片。從照片中，本席留意到第8座外牆在該工程後的狀況並不是明顯遜於第7座 (關先生是第7座其中一單位的業主) [65]。 在該工程前 [124-125]， 第8座的外牆已有油漆脫落或污水痕。A 並沒有倚賴任何專家證供引證其說法。再者，本席亦認為，就維修外牆 (如果成立) 的費用，損害賠償是一個充分及足夠的賠償。

(5) 至於建築物外觀，由於該屋苑總體上的外觀已經完全改變，本席不認為第 8 座的外觀改變會對A 造成任何實質損失。本席亦留意到關先生就第7座的外觀改變並沒有作出任何投訴。

(6) 在本案中，並沒有任何事實或專家證據證明該工程導致第8座因該工程引致任何結構上的危險。

(7) 自從該工程完工後，A並沒有提出須跟進的事項。正如上文所述，唯一在該工程後發生的事情，即NOA 第9A(9) 段，A 已確認不再跟進。

(8) 本席並沒有忽略R 的立場是願意進行某些拆除工程。但如上文所述，由於雙方並沒有共識，本席必須就雙方的爭議作出裁決。 本席同意Wilmes第66段的考慮，即雖然沒有證據顯示R 需要承受的費用， 遵守強制令的費用明顯不是一個小數目。

4.8  基於以上原因，本席拒絕就NOA 第9A(1)-(8) 段作出強制命令。

NOA 第9A(10)-(11) 段

4.9  NOA 第9A(10)-(11) 段的申請明顯地可從損害賠償得到一個充分或足夠的賠償。該公契第10 條訂明：

“If any of the parties hereto failed to fulfil any of his obligations hereunder within 2 months from the date of any written notice from the other or others of them requiring the same to be fulfilled then the party or parties serving such notice may at his or their absolute discretion proceed to have such obligation fulfilled at the cost and expense of the defaulting party and the defaulting party shall be demand repay to such other party or parties such cost and expense…”

4.10  正如上文所述，本席已裁定A 並沒有在污水渠事件前就NOA 第9A(10)-(11) 段事項作出投訴。在本案中，亦沒有任何合理的解釋為何A 沒有根據該公契第10條先作出維修，然後向R就維修費用作出申索。

4.11  本席拒絕就NOA 第9A(10)-(11) 段作出強制令。

NOA 第9B段

4.12  由於本席拒絕就NOA 第9A段作出強制令，本席不需就NOA 第9B段作出任何命令。本席必須強調，即使本席就NOA 第9A段作出強制令，本席認為不適宜就NOA 第9B 段作出任何命令。

4.13  首先，就NOA 第9B(1) 段而言， 本席認為A 申請的命令並不清晰。本席不明白何謂 “影響範圍”。例如，如果維修工程需要搭棚， 根據A 申請的命令，是否不可以在外牆進行搭棚工程？

4.14  第二，就NOA 第9B(2) 段而言，本席認為亦不恰當。承建商有責任就工程設計一套安全的施工工序。 本席不認為在現階段需要干預。

4.15  第三，就NOA 第9B(3) 段而言，本席看不到任何理由為何承建商不可以在星期六上午時段進行工程。

NOA 第9C段

4.16  NOA 第9C段不是一項強制令，而是一項禁制令，命令R 不再違反限制性契約 (negative covenant)。 由於R 有違規作為的前科，本席認為根據NOA 第9C 段作出命令是適合的。

5.  R 的反申索

5.1  由於本席拒絕就NOA 第9A段作出命令，因此本席不需要就反申索二作出命令。

5.2  R 於2010年4月8日成為R 物業的業主。 反申索一至五於2023年4月3日提出。R1 在庭上承認於2010 年10月前已得悉反申索三至四涉及的事項。 本席不接納R1 在2016或2017年才得悉反申索五涉及的事項並裁定R 亦於 2010年 10月前得悉該些事項。

5.3  本席同意A 的陳述，即反申索一至五有違時效條例就公契提出申索的12年時效。

5.4  特別關於反申索一，R 的訴因是基於違反該公契或該條例第34I 條。R的案情是該平台的位置是在該屋苑地段邊界外，因此該公契或該條例第34I條 並不適用於該平台：Perect China International Ltd v Chan Yat Siu and Yeung Kam Luen, LDBM 24 of 2011, 20 July 2012 第26段。

5.5  即使該公契適用於該平台，本席亦會行駛酌情權拒絕頒布強制令：見上文第2.5 及3.8 段。

5.6  基於以上原因，本席撤銷反申索一至五。

6.  總結

6.1  就A的申請，本席頒布禁制令， 禁止R 及R物業的佔用人在該屋苑第八座再次建設任何違規或不合法的僭建物/構築物/渠管/結構。

6.2  本席拒絕就A 的其他申請作出命令。雖然本席對A 提出本申請的動機有所保留，但本席認為A的申請是有合理理據提出。

6.3  相反，縱使本席明白R 作出反申索是基於 R 認為本申請是針對性而作出的 “反射動作”，但本席認為R 提出的反申索基於時效條例或超越其訴因範疇並沒有充分理據。

6.4  基於以上原因，本席頒下臨時訟費命令：R 須支付A 本申請80% 訟費及反申索的所有訟費，如果雙方未能就數額達成協議，則由法庭以區域法院基準釐定。若雙方不在本裁決後14天內提出訟費申請，則上述的臨時訟費命令作實。
