簡介

1.  這件案件牽涉一宗於2011年1月21日在中國內地發生的交通意外。

2.  原告人（“飛聯＂）日期為2013年1月10日的再經收改申索陳述書是用英文撰寫，內容包括如下：

“3. The Defendant was in the employ of the Plaintiff as a Tractor driver since February 1998 driving the Tractor between Hong Kong and People’s Republic of China in the transport and delivery of goods and cargo at the wage calculated at 27% of the charges for every job for which the Defendant transported and/or delivered its goods or cargo inclusive of any allowance for holidays and annual leave and there was no fixed date or time for work (hereinafter referred to as “the Employment Contract”).

4. There were, inter alia, the following implied terms (hereinafter referred to as “the said Implied Terms”) in the Employment Contract, in order to give the same business efficacy, that:-

(a) the Employment Contract was personal to the  Defendant so that the Defendant had to drive the Tractor by himself and should not and could not discharge and/or delegate the Defendant’s duties and obligations to other persons; and ……

5. On or about 21^st day of January 2011, without the knowledge, consent or authorization of the Plaintiff, and in breach of the Defendant’s said Employment Contract with the Plaintiff, the Defendant wrongfully engaged a resident of the People’s Republic of China, with the name called 鄒永峰 (Zhou Yong-feng) (hereinafter referred to as “Zhou”) to drive the Tractor for the Defendant in Mainland China area.

6. On or about 21^st day of January 2011 at around 12:20 p.m. when Zhou was driving the Tractor for the Defendant in breach of the Employment Contract as aforesaid along Guangshan Highway（廣汕公路）from Shantou （汕頭 ）to Shenzhen (深圳 ) direction,  at about the location of Haifeng County G324 lane 694 KM+ 400M, the Tractor had a head on collision with a  motor cycle of no registration number causing fatal accident to the motor cycle driver 莊仲發and personal injuries to the motor cycle passenger 黃龍寬.”

被告人的立場

3.  根據被告人（“李先生＂）之抗辯書，在2011年1月20日中午時份，李先生接獲公司負責人施蓮娜小姐如常地致電通知李先生須於2011年1月21日 上午時份，將一貨櫃箱貨物送抵國內汕頭一間廠房。當時李先生因感冒身體不適，而前往汕頭之路途遙遠，李先生認為不適宜長途駕駛車輛，故此，李先生向施蓮娜小姐說明因由及要求可否延期將貨物送達。而施蓮娜小姐稱必須依時將貨品送抵該廠房，而貨品亦已報關不能更改公司其他司機送運過關。李先生便提議由他取貨後將貨品運送過關後僱用國內司機代為將貨依時送達廠房。根據李先生之說法，當時施蓮娜小姐並沒有反對。

4.  明顯地，飛聯向李先生的申索是完全建基於上述申索陳述書內第4(a)段所提出之“穩含條款（implied term）”。而根據飛聯的說法，有關之穩含條款是基於“商業效能（business efficacy）”。

5.  飛聯傳召了其中一位董事，施連財先生（“施先生＂）作證。施先生在盤問下有以下證供：－

（1）在這行業內，行規是僱主與僱員會將責任攤分；

（2）就算僱員在未得到僱主批准的情況下找來代替司機，僱主與僱員仍會攤分責任；

（3）從2011年1月事發當日至2011年4月李先生離職期間，飛聯並沒有向李先生提出賠償之要求；

（4）假若李先生沒有在2011年4月辭職，飛聯並不會向李先生作出申索。

6.  明顯地施先生上述之證供，並不支持有關穩含條款之存在。換個角度來看，有鑑於施先生所指的行規，李先生明顯地並不會接受在申索陳述書第4(a)段內聲稱的穩含條款。

7.  鑑於以上分析，飛聯未能履行作為原告人的舉證責任，證明李先生有違約及有向飛聯作出賠償的法律責任。

命令

8.   原告人針對被告人的申索予以撤銷。

9.  原告人須支付被告人因本訴訟引起的訟費，包括保留代決的訟費（如有）。除非雙方同意，否則訟費由法庭評定。此訟費命令乃暫時性；除非任何一方於14天內向法庭申請更改，否則此訟費命令將自動作實。
