D E C I S I O N

________________________

1.  By summons dated 9 September 2025 (“the Summons”), the plaintiff applies for interlocutory injunctions against the 1^st and 2^nd defendants in respect of its claims in trademark infringement and passing off.

2.  The first hearing of the Summons took place before this court on 12 September 2025. None of the defendants appeared at that hearing. This court granted an interim injunction in favour of the plaintiff pending the determination of the Summons, and gave directions to the parties for the filing of evidence for the purpose of the Summons.

3.  The defendants have filed no affirmation in opposition eventually.

4.  By the third affidavit of Maria Francesca Portincasa, it is shown that the defendants were given due notice of the interim injunction and the present hearing by a letter of the plaintiff's solicitors dated 25 September 2025. I am satisfied that the letter was duly served on the defendants. None of the defendants has given any response to the letter and these proceedings at all.

5.  In the circumstances, this court is satisfied that the defendants have knowledge of the present hearing and opted to be absent. I shall proceed to consider the Summons in their absence.

6.  The Summons is supported by the affidavits of Maria Francesca Portincasa. In her affidavits, the following allegations are made.

7.  The plaintiff has been a renowned designer, manufacturer and distributer of super-sports cars and a global lifestyle products with operations in more than 50 countries worldwide since 1963. The plaintiff have duly registered the following trademarks in Hong Kong (collectively “the Registered Marks”) :

(1)  Lamborghini Mark;

(2)  Automobili Lamborghini Mark;

(3)  Raging-Bull Device Mark;

(4)  Lamborghini Wood Mark.

8.  The details of the Registered Marks are contained in the schedule annexed hereto.

9.  The plaintiff has through its authorized dealers, promoted, distributed and sold its sport cars under the Registered Marks extensively since 1992 and has acquired valuable goodwill in Hong Kong. The Registered Marks are distinctive of the car products of the plaintiff.

10.  The 1^st defendant is a Hong Kong company operating a bar business under the business name “GHINI LOUNGE” (“the Offensive Trade Name”), situated at Shop G01, Ground Floor, The Centrium, 60 Wyndham Street, Central, Hong Kong.

11.  The 2^nd defendant is a Hong Kong resident and the sole director of the 1^st defendant.

12.  The alleged infringing activities of the defendants since August 2025 include:

(a)  operating its bar business in the Offensive Trade Name and by reference to marks confusingly and deceptively similar to the Registered Marks (“the Offensive Marks”) and promoting its bar business via its social media accounts including @ghini_hk and @lambopower_energyforun under and by reference to the Offensive Marks; and

(b)  in the course of its business, promoting, offering to sell and selling beverage products, namely, “automobile Lamborghini ENERGY FORUN” (“the Infringing Products”) which bears the Offensive Marks under and by reference to the Offensive Trade Name and/or the Offensive Marks in its GHINI LOUNGE;

13.  Further details of the infringing activities were given by way of photographs. At the entrance of GHINI LOUNGE, as depicted in a photograph, one of the Offensive Marks which is identical to the Raging‑Bull Device mark, and a mark incorporating the Automobili Lamborghini mark were displayed prominently as at 2 September 2025.

14.  Moreover, some photographs show that the Infringing Products bear the Automobili Lamborghini mark and the Raging-Bull Device mark.

15.  The Infringing Products were apparently imported by Jarvis Energia Limited and the supplier appears to be a company in Shanghai. The plaintiff has given no authorization to the import of the Infringing Products.

16.  The 2^nd defendant is a director and shareholder of Jarvis Energia Limited.

17.  Having been alerted to these infringing activities of the defendants, the plaintiff on or around 11 August 2025, on its official website, published an announcement (“the Announcement”) stating that GHINI LOUNGE has never been authorized by the plaintiff to use any of the Registered Marks and the plaintiff has no relationship with GHINI LOUNGE whatsoever.

18.  About two days later, in response to the Announcement, a post was published jointly on the Instagram accounts of GHINI LOUNGE and Mr David Fenn entitled “律師聲明”(“the Statement”), which claims, inter alia, that: -

(a)  the Announcement contains misrepresentation and defamatory statement(s);

(b)  GHINI LOUNGE has been authorised by the relevant authorizer to use “company’s trademark”; and

(c)  GHINI LOUNGE is the authorised dealer of the Infringing Products and will continue to offer the Infringing Products with a view to ensuring the continued supply of affordable luxury products for new generations so that the superior taste of the super sports car brand can be enjoyed with affordable prices.

19.  This Statement is alarming indeed and the plaintiff instructed its current solicitor to issue a letter to the defendants on 3 September 2025, demanding the defendants to stop their infringing activities forthwith. There has been no reply to the said letter.

20.  Despite the strong position taken by the defendants in the Statement, they did not see fit to file any evidence to support their assertions and oppose the Summons.

21.  On the uncontradicted evidence of the plaintiff, which is well supported by documentary evidence, I am satisfied that the defendants have arguably committed the tort of passing off and trademark infringement in contravention of sections 18(2) and (3) of the Trade Marks Ordinance, Cap. 559.

22.  The trial should be some time away. I am satisfied that the plaintiff is in urgent need of interim protection against further infringements of the defendants pending the determination of this action. The Statement shows that the defendants remain impenitent.

23.  Given the strong merit of the plaintiff's claim and indeed the absence of any challenge thereto, I believe I do not have to consider the question of balance of convenience: see Yeko Trading Limited v Chow Sai Cheong Tony T/A Stockwin and Others (unreported, HCA 2163/2000, 12 April 2000).

24.  I am also satisfied that damages would not be an adequate remedy. Any injury or harm caused to the goodwill of the plaintiff is notoriously difficult to be measured and cannot be sufficiently compensated by an award of damages. In the circumstances, I agree with Mr Hui, for the plaintiff, that it is indeed an appropriate case to grant interlocutory injunctions against the defendants.

25.  I have gone through the orders sought in the Summons with Mr Hui and I am satisfied that the plaintiff is entitled to all such interlocutory remedies. I make an order in terms of the Summons as amended.

26.  Lastly, I thank Mr Hui for his fair submissions and helpful assistance.
