COURT: The defendant has pleaded guilty to one count of trafficking in a dangerous drug, contrary to section 4 of the Dangerous Drugs Ordinance. He is committed to this court for sentence.
In the evening on 10 January 2023, the defendant was stopped by police officers at Yau Ma Tei. Upon a search of the defendant’s bag he was carrying, 59.4 grammes of cocaine was found.
The street value was estimated to be between HK$60,000 to HK$90,000, depending on the form of the dangerous drug.
The defendant is now 44, educated up to Form 3 level. Prior to his arrest he was unemployed. He has 14 criminal records, the latest one is also trafficking in a dangerous drug which he was sentenced to 9 years and 6 months in 2015 upon a plea. Judging from the length of that sentence, the amount of drug involved must be substantial.
The starting point for trafficking in 59.4 grammes of cocaine, based on quantity alone, is one of 8 years and 3 months’ imprisonment. In this particular case, an
additional 1 year will be added for his previous trafficking record, as well as his various possession of dangerous drugs records.
The only mitigating factor in this particular case is the defendant’s earliest plea.
In conclusion, for the offence the defendant stands convicted, he is therefore sentenced to 6 years and 2 months’ imprisonment.
