判案書

高等法院上訴法庭法官彭偉昌頒發上訴法庭判案書：

1.  本案原審時有十二名被告，申請人是當中的第十一被告，他們全部被控以一項‘暴動’罪，結果有十一人被定罪。申請人接著提出定罪上訴許可申請，申請在聆訊後被本庭駁回，申請人的上訴亦同時被駁回。案中的一切相關事實和本庭的判案理由見 [2023] HKCA 975（日期：2023年8月18日），不在這裡重複。

動議

2.  2023年8月25日，申請人存檔動議通知書，要求本庭證明案件具有重大而廣泛重要性的法律觀點，以便向終審法院提出上訴許可申請。

3.  以下是申請人擬提出的法律觀點：

「 就以鼓勵其他參與集結者作出受禁行為的方式參與暴動罪行而言，法律是否要求該在場從犯或二級主犯須『積極』鼓勵一級主犯干犯該罪行？」

“ For the purpose of taking part in the offence of riot by way of encouraging the performance of the prohibited conduct by other participants in the assembly, does the law require the accessory at the fact or the principal in the second degree to ‘actively’ encourage the principal in the first degree to commit the offence?（譯文）”

4.  申請和答辯方同意，本庭可以書面方式處理這動議。

陳詞

5.  代表申請人的是關文渭和梁寶琳兩位大律師，他們的關鍵陳詞可撮要如下。

6.  Hawkins J在英國案例R v Coney (1882) 8 QBD 534表示（判詞第557頁）：

“ In my opinion, to constitute an aider and abettor some active steps must be taken by word, or action, with the intent to instigate the principal, or principals. Encouragement does not of necessity amount to aiding and abetting, it may be intentional or unintentional, a man may unwittingly encourage another in fact by his presence, by misinterpreting words, or gestures, or by his silence, on non-interference, or he may encourage intentionally by expressions, gesture, or actions intended to signify approval. In the latter case he aids and abets, in the former he does not. (emphasis added) ”

7.  約八十年後，Devlin J 在National Coal Board v Gamble [1959] 1 QB 11表達了他對這段判詞的理解。這理解在再多十年後的Tuck v Robson [1970] 1 WLR 741被 Lord Parker CJ解讀為（判詞第746頁）：

“ I take [Devlin J] to mean there that proof of active encouragement is necessary to every form of aiding and abetting. (emphasis added) ”

8.  同時，‘active encouragement’（‘積極鼓勵’）的概念亦被適用到暴動罪的分析之上，案例是R v Caird (1970) 54 Cr App R 499（判詞第505頁）：

“ It is the law-and, indeed, in common sense it should be the case- that any person who actively encourages or promotes an unlawful assembly or riot, whether by words, by signs or by actions, or who participates in it, is guilty of an offence which derives its great gravity from the simple fact that the persons concerned were acting in numbers and using those numbers to achieve their purpose. (emphasis added) ”

9.  在香港，協助或教唆者須有‘積極’言行才罪成的原則，其實一路都有案例支持，及至HKSAR v Chan Kam Shing (2016) 19 HKCFAR 640則由終審法院把它確認下來（判詞第10段）：

“ The aider and abettor must provide active assistance or encouragement by words or action. (emphasis added) ”

10.  最後，Chan 案的觀察，終審法院在HKSAR v Lo Kin Man (2021) 24 HKCFAR 302有採納（判詞第68段），所以Lo案第81至86段，即被本庭指為迄今最權威的相關論述，雖然沒有明確提及，但‘積極’的要求還是應該適用到何謂鼓勵暴動的分析上面。這點須由終審法院去澄清。

討論

11.  R v Clarkson [1971] 1 WLR 1402是關/梁兩位大律師援引的另一宗案例。在該案，Megaw LJ在引述過 Hawkins J在Coney的判詞後指出（判詞第1406頁）：

“ It is not enough, then, that the presence of the accused has, in fact, given encouragement. It must be proved that the accused intended to give encouragement; that he wilfully encouraged. In a case such as the present, more than in many other cases where aiding and abetting is alleged, it was essential that the element should be stressed, … (emphasis added) ”

12.  綜合以上各英國案例的觀察，意思其實非常明確，而且和Lo 案判詞第81至86段所講的沒有分別，撮要見本庭在 [2023] HKCA 975第35段：

「 35. …. 六段判詞反復強調的是，‘光出現在現場’（mere presence）本身不足以構成‘鼓勵’，就是這麼簡單，至於特定的個案是否具備構成‘鼓勵’的額外行為則要視乎具體情況，而且門檻不高，唯獨這些行為必須附帶相關的意圖（“necessary that there be some intentional activity in furtherance of the riot”）。」

13.  亦因為以上的原因，本庭在 [2023] HKCA 975第35段的開端指出，‘積極’只是一個詞，這詞並未為Lo 案對‘鼓勵’的解釋帶來任何添加。在第36段又說，既然有了Lo 案的解釋，就無謂再拘泥於嚴格來說是另一議題的用語。

結論

14.  總括而言，本庭不認為申請人提出的問題是需要終審法院澄清的法律問題。本庭拒絕發出有關的證明書。
