NOTIFICATION of the Judge’s decision (Ord. 53 r. 3)
Following;
Order by Deputy High Court Judge K.W. Lung:
1. Leave for the applicants to apply for Judicial Review of the Board’s Decision dated 6 May 2019 be granted; and
2. The applicant shall issue the originating summons for hearing within 14 days from the date of this Order, pursuant to Order 53, rule 5 of the Rules of the High Court.
3. A copy of this Order be served on the Director of Justice, who shall work out the proper directions for the judicial review hearing with the applicant.
4. Liberty to apply.
Observations for the Applicant:
1. Leave is granted to the applicant to apply for judicial review of the Board’s Decision dated 6 May 2019 for the reason that the Board did not consider the merit of the case, contrary to the decision of the Court of Appeal[1].
2. The applicant shall issue the originating summons for hearing within 14 days from the date of this Order, pursuant to Order 53, rule 5 of the Rules of the High Court.
3. A copy of this Order be served on the Director of Justice, who shall work out the proper directions for the judicial review hearing with the applicant.
4. Liberty to apply.

b) issue the originating summons within 14 days after the grant of leave and serve it in accordance with Order 53, rule 5; and
c) supply to every other party copies of every affidavit which the Applicant proposes to use at the hearing, including the affidavit in support of the application for leave (Order 53, rule 6(5)).
