CRIMINAL CASE NO 489 OF 2016
----------------------
----------------------
| Before: |
HH Judge Woodcock |
| Date: |
3 November 2016 at 11.41 am |
| Present: |
Mr Phil Chau, Counsel on fiat, for HKSAR |
|
Mr Duncan Percy, instructed by Kenneth W Leung & Co,
for the defendant |
| Offence: |
Careless driving (不小心駕駛) |
---------------------
Reasons for Sentence
---------------------
1. Defendant, please stand up. You pleaded guilty on the first day of trial to careless driving.
2. I have found you not guilty of dangerous driving, but guilty of careless driving.
3. Despite the awful consequences and the desperate predicament of the victim, I look at the manner of your driving to decide the sentence.
4. I will impose a financial penalty. I impose a fine of $4,000.
5. I have considered whether it is necessary to disqualify you, and I do not find that your manner was so careless that it is necessary to disqualify you. I am sure you have modified the way you drive as a result of this accident.
6. I will add though that if there had been evidence that you sped up to make the green light, I would have found that dangerous, but there was not sufficient evidence, despite my suspicions. Drivers often drive like that when they are particularly familiar with roads and the lights. So I hope that is something you bear in mind every time you get in your car.
