判案書

上訴法庭副庭長林文瀚頒發上訴法庭判案書：

1.  申請人為區域法院婚姻訴訟案件編號2005年第12452號之答辯人，於2020年9月4日以傳票存檔申請批准上訴區域法院法官麥莎朗於2020年8月21日的判決。該判決為拒絕批准申請人就區域法院暫委法官李素蘭(當時官階)於2007年2月12日所作出命令提出逾期上訴。2007年2月12日之命令如下：

(1)     訴訟雙方同意家庭子女(即雙方之兒子)管養權批予答辯人(即申請人)，呈請人得合理探視；

(2)     訴訟雙方同意呈請人須每年繳付港幣1元象徵式贍養費予答辯人，由暫准判令轉為絕對判令開始直至雙方結束共同生活或答辯人再婚，以較短者為準，抑或直至法庭另有命令；

(3)     呈請人須每月繳付港幣1,000元予答辯人作為家庭子女臨時贍養費；

(4)     家庭子女贍養費事宜押後至2007年5月2日內庭審理。

2.  較早前，申請人於2020年1月13日曾在區域法院家事法庭針對2007年2月12日之命令提出逾期上訴許可申請。區域法院法官麥莎朗於2020年8月21日[2020] HKFC 171拒絕批准申請人逾期上訴。

3.  麥法官於其判案書第2段指出：

“ 2.   The decree absolute was granted on the 22 August 2007 – some 13 years ago. There is no order concerning the distribution of property and the only order for maintenance was an interim order that the husband pay the wife HK1,000 per month as maintenance for the child of the family. This is dated the 2 May 2007. By a previous order dated the 12 February 2007 custody of the child of the family was granted to the wife and a further order was made for nominal maintenance of HK$1 per annum to be paid by the Petitioner husband to her. The decree nisi was dated the 16 May 2006.”

「 2.   2007年8月22日，大約13年前，法庭頒佈了本案的絕對離婚令。案中並無關於財產分配的命令，而唯一有關贍養費的命令是一項臨時命令：丈夫須每月支付港幣1,000元予妻子，作為有關家庭子女的贍養費。這項命令的日期為2007年5月2日。根據之前日期為2007年2月12日的命令，妻子獲批予有關家庭子女的管養權，法庭又作出進一步命令：呈請人(丈夫)須每年支付象徵式贍養費港幣1元予答辯人。本案的暫准離婚令日期為2006年5月16日。」

4.  在同一宗婚姻案件中，申請人於2018年10月18日存檔表格8(關於申請附屬濟助的通知書)以及分別於2019年6月14日及2019年11月13日存檔表格25 ([擬繼續進行]附屬濟助申請通知書)。家事法庭於2020年7月15日將這些申請押後至2020年12月15日審理。該三項附屬濟助申請關乎更改子女及配偶贍養費令、以及財產分配或轉讓。

5.  2020年9月25日呈請人提交其反對陳述書。

6.  在下級法院拒絕給予逾期上訴許可，申請人可以向本庭重新提出逾期上訴許可的申請。就下級法院拒絕給予逾期上訴許可提出上訴不是合適的程序：Tang Chai On v Tang Sing Ki [2016] 5 HKLRD 104。本庭視申請人的申請為向本庭重新提出針對2007年2月12日命令的逾期上訴許可申請。

7.  就法庭審理申請逾期上訴許可，本庭已於Tang Chai On v Tang Sing Ki [2016] 5 HKLRD 104 判案書中第九段闡述相關原則：

“ The legal principles regarding an application to extend time for an appeal are well established. In the exercise of its discretion, the court will take into account the length of the delay, the reasons for the delay, the chances of the appeal succeeding if an extension of time is granted, and the degree of prejudice to the other party if the application is granted. Where the delay is substantial and not wholly excusable, the applicant must show a real prospect of success on the merits, not merely a reasonable prospect of success.”

8.  換言之，法庭行使酌情權決定批准逾期上訴與否時，當考慮：

甲﹑ 延遲時間長短；

乙﹑ 延遲理由；

丙﹑ 倘批准延期，上訴成功機會；

丁﹑ 倘批准延期，對訴訟對方之損害程度。

9.  當延遲頗長而申請人就延誤沒有合理辯解，申請人必須顯示有真確勝訴機會。

10.  由2007年區域法院頒令至申請人於2020年1月13日在區域法院申請上訴許可，逾期十餘年，延遲非常長。本庭考慮過申請人的解釋，不接納她就這麽長的延誤有合理辯解。她個人處境的困局不足以解釋她長期未有就她認為不公的判令提出上訴許可的申請。

11.  再者，本庭認為她擬提出的上訴毫無勝訴機會。

12.  麥法官於其判案書第12段指出：

“ 12. In this instance the wife is seeking leave to appeal in three aspects.

1)   Distribution of property

There has been no order with respect to the distribution of property. Consequently, it follows, that it is not possible to seek leave to appeal against something that does not exist. It is also note that there has been no dismissal of claims. If the wife now maintains that the husband had assets which he did not disclose at the time of the divorce, then she has other possible remedies that might be open to her. Seeking leave to appeal is not one of them.

2)   the maintenance order

The nominal maintenance order was made by consent. The maintenance for the child was made on an interim basis as he was in foster care at the time and the long term arrangements for his care had not been finalized. It is open to the wife to apply to vary both orders. However, there is no basis for an application for leave to appeal.

3)   the decree absolute of divorce made on the 12 February 2007

As indicated above the decree absolute was actually granted on the 22 August 2007 and not the 12 February 2007.  The wife was duly served with the divorce proceedings and she attended every hearing thereafter.  She did not defend those proceedings.  She has not identified any basis upon which the court could give leave to appeal in such circumstances.”

「 12. 在本案中，妻子就三方面尋求上訴許可。

1)   財產分配

就財產分配方面並無命令。因此，妻子不可能對不存在的東西尋求上訴許可。此外，值得注意的是，案中並無駁回申索。若妻子現堅稱丈夫離婚時有資產而沒有披露，那麼她或者可以選擇其他可行的補救方法，而尋求上訴許可並非其中之一。

2)   贍養費命令

案中的象徵式贍養費命令是在雙方同意下作出的。由於當時兒子正由寄養家庭照顧，而且對於照顧他的長期安排尚未作出最後決定，故關於兒子的贍養費命令是在臨時性的基準上作出的。妻子可選擇申請更改該兩項命令。然而，她並無申請上訴許可的依據。

3)   2007年2月12日作出的絕對離婚令。

正如上文所述，絕對判令其實是於2007年8月22日批出，而非2007年2月12日。妻子獲妥為送達有關離婚訴訟程序的文件，而自每次聆訊她亦有出席。對於該等訴訟程序，她並無提出抗辯。在,此等情況下，她沒有指出任何讓法庭可賴以給予上訴許可的依據。」

13.  本庭同意麥法官以上的分析。就財產分配及子女及配偶贍養費事宜，申請人應該在將於2020年12月15日審理的三項附屬濟助申請中處理。

14.  至於申請人指稱對方有所隱瞞而引致贍養費安排不公平或不合理，申請人目前未有確實的證據支持她的指控。

15.  至於絕對離婚判令，這不是2007年2月12日所作出的命令，所以不可構成申請人於2020年1月13日傳票的申請。

16.  而且申請人未能提出任何足以推翻該絕對離婚判令之理由。在這方面麥法官判案書第12(3)段已清楚交代。

17.  基於上述理由，本庭認為申請人擬提出的上訴無任何成功機會，因此拒絕逾期上訴許可，並撤銷申請人2020年9月4日於本案存檔之傳票。

18.  由於訴訟雙方均未有按《實務指示4.1》及上訴司法常務官2020年9月21日所指示提交訟費陳述書，本庭不作任何訟費命令。

19.  根據《高等法院規則》第4A章第59號命令第2A條規則第(8)款，本庭亦命令本案任何一方不得要求在各方之間的口頭聆訊中重新考慮此裁定。
