RULING ON COSTS

1. This is my ruling on costs.
2. In the statement of costs for the summary assessment, a total sum of $37,436 is stated to be the 2nd defendant’s costs of the application for leave to appeal before me.
3. I allow the following amounts of $516, $3,330, $8,290 and $20,000 respectively for Items B (manual work), C (communications), D (professional work) and E (counsel).
4. I have reduced Item C1 by 1 hour (HK$2,650) and Item D1 by 1 hour (HK$2,650) for reasons of duplication and/or being excessive.
5. On a nisi basis, therefore, I assess the costs payable to the 2nd defendant by the plaintiff, on a party and party basis, in the sum of $32,136.
