判 案 書

上訴法庭法官潘兆初頒發上訴法庭判案書：

1.  2017年6月2日，原訟法庭法官陸啟康命令撤銷原告人於2017年4月26日存檔的上訴通知書。原告人不服，在2017年7月7日存檔上訴通知書，針對陸法官的命令提出上訴。

2.  2017年3月7日，原訟法庭法官周家明頒下命令：

“ 1. No legal proceedings shall without the leave of the Court of First Instance be instituted by the Defendant [施華芬];

2. Any legal proceedings instituted by the Defendant [施華芬] in any court or tribunal before the date of this Order shall not be continued by the Defendant [施華芬] without the leave of the Court of First Instance;

3. The above restrictions shall cease to have effect at the end of 10 years from the date of this Order and shall be confined to legal proceedings by the Defendant [施華芬] against the following parties only, namely :

(1) Tam Kam Yuk (譚金玉);

(2) Yuen Wai Noong (袁偉農);

(3) Lin Kwok Pun (練國彬);

(4) Leung Shi Wing (梁仕榮);

(5) Watt Koon Ying (屈冠英);

(6) Paul Kwong & Co. (鄺偉全律師行); and

(7) Lee Po Wing (李寶榮).”

原告人在提出本上訴前，並未取得高等法院原訟法庭法官的許可。

3.  因為原告人未獲原訟法庭法官許可，她不能提出本上訴。因此，本庭撤銷原告人的上訴，並命令她支付被告人的訟費，訟費數額以簡易程序評定為HK$5,000.00。
