1.  申請人於2020年10月9日存檔申請通知書，要求法庭判令答辯人，根據大廈公契，支付下列金額:-

(a) 答辯人所須承擔，第一期至第三期的大廈消防改善工程費用及工程備用金分攤金額共97,875元;

(b) 申請人因答辯人未支付上述分攤金額而經律師擬備及註冊押記備忘錄的費用共7,000元;

(c) 答辯人所須承擔由2018年至2020年公眾第三者責任保險費及火險保費共3,250元;

(d) 答辯人所須承擔2019年的公眾冲廁的維修費用312.50元;

(e) 利息及本申請的訟費。

2.  申請通知書於2020年10月12日派達答辯人；代表申請人的梁鄧蔡律師事務所於2020年10月14日經已存檔Cheung Wing Yin的誓章作派送證據。

3.  答辯人並沒有存檔或派達反對通知書。在2021年9月24日，申請人存檔排期聆訊申請書及鄧偉強的證人陳述書。案件今天排期在本席席前審理，有關的聆訊通知書已派達答辯人，但答辯人並沒有出庭應訊。

4.  由於答辯人並沒有存檔反對通知書，亦沒有出庭應訊，本席接納代表申請人的柳律師申請，在答辯人缺席下，正式聽取證供，以審理申請人的申請是否成立。

5.  申請人只傳召一位證人，即上述的鄧偉強先生 (“鄧先生”) 。鄧先生採納日期為2021年9月24日的證人陳述書為他的口供，及呈堂鄧先生在他的證人陳述書內附錄的有關文件。

6.  根據鄧先生的證人陳述書，他是申請人歌賦街41號業主立案法團管理委員會的秘書。本席採納鄧先生的證供，即申請人是根據香港法例第344章成立的業主立案法團，對大廈的公用部份具控制、管理和行政權。

7.  鄧先生亦呈堂有關歌賦街41號地庫連後院單位 (“地庫單位”) 的土地註冊紀錄，證明答辯人是地庫單位在有關時間的註冊業主。本席接納鄧先生的證供。

8.  鄧先生又引述2017年9月18日的業主大會的決議，並呈堂有關的會議記錄，顯示業主大會通過出資683,000元作大廈改善消防工程的費用，及收集100,000元的工程備用金。上述的費用由各業主 (包括答辯人) 分三期支付。

9.  鄧先生亦呈堂適用於該大廈的一份公契，即日期為1973年6月28日的一份公契，並在土地註冊處以編號UB1008402登記　 (“該公契”) 。本席接納代表申請人的柳律師的陳述，同意該公契適用於該大廈。

10.  柳律師在陳詞時亦向本席引用該公契，包括第3、第4及第15段的內容。其內容如下：

“3. Each of the parties hereto shall pay its due proportion of:

(a) The Crown Rent the rates for water (where no separate meters installed) consumed on the said Land and the said Building and insurance premium payable on the policy (if any) for insuring the said Building against loss or damage by fire.

(b) The cost of keeping in good and tenantable repair and condition the foundation, the side walks, main walls; supports, beams, gutters, fences, chimneys and all external parts of the said Building and all the drains, wells, electric pumps, water tanks, pipes, conduits and all plumbing apparatus (if any) intended for the general service of the said Building (except as regards damage caused or resulted from any act or default or negligence of any of the parties hereto their respective servants or agents or tenants or licensees) and the entrance-hall, staircases, landings and the common passages thereof.

(c) The cost of rebuilding or re-instatement of the said Building or any part thereof in case of destruction or damage or condemnation by the Building or other competent Authority.

(d) Watchmen’s fees, the wages for the caretakers and janitors.

(e) The cost of repairing redecorating and lime washing the said Building and the costs of installing the fire service equipments.

4. The amount which each of the parties hereto shall be liable to pay or contribute under Clause 3 hereof shall be in proportion to its share of and in the said Land the said Building.

15. If any of the parties hereto shall fail to pay or otherwise fulfil its share of the re-instatement of or repairs to the said Building if such reinstatement or repairs should become necessary or shall fail to pay its share of the cost of such re-instatement or repairs or all general expenses as mentioned in Clause 3 hereof within two months from the date of any notice from the other of them requiring the same to be done or paid then the party serving such notice may at its own absolute discretion proceed to carry out such re-instatement or repairs and pay for the same or pay the said share of the cost and the defaulting party shall on demand forthwith pay to the other party or parties its share of the costs and expenses incurred in such re-instatement or repairs and until such repayment in full the said costs and expenses or such part thereof as shall remain unpaid shall be a charge upon the share of the defaulting party of and in the said Land and the said Building.”

11.  本席接納柳律師的陳詞，即改善消防工程費用及備用金，根據該公契第3段，屬維修該大廈的開支。又根據第4段，分攤的比率應按各業主所佔土地的分數分攤。根據該公契，該大廈的總業權分數為8份，而地庫單位佔其中1份，故答辯人應負責l/8的費用，即783,000元 / 8 x 1 = 97,875元。本席接納鄧先生的證供，申請人經已多次通知答辯人須支付的三期分攤費用，但答辯人至今仍未支付。所以裁定答辯人須付申請人該費用。

12.  又根據該公契第15段，任何業主如沒有支付根據該公契第3段須支付的費用，在發出通告超過兩個月後，則該欠款可押記在不遵守公契要求付款的業主的業權上。故根據該公契，申請人透過律師事務所向地庫單位登記押記令 。律師事務所的收費為7,000元。

13.  本席同意申請人有權進行押記，而有關的律師費用須由答辯人承擔。

14.  鄧先生又作證指申請人在業主周年大會中，通過於2018年至2020年，購買大廈的第三者責任保險及火險，並由各業主分攤。有關的會議記錄呈堂。答辯人並沒有支付有關的分攤費用，共3,250元。申請人向答辯人追討欠款。

15.  為大廈購買保險是業主立案法團的權責。本席接納鄧先生的證供，申請人議決購買保險及各業主的分攤費用，裁定答辯人須支付申索的金額。

16.  鄧先生又指答辯人拖欠繳交大廈公眾沖廁水管之維修費用共312.50元。他引述2019年8月6日業主大會會議記錄作支持。本席接納鄧先生的證供，裁定答辯人須付還312.50元。

17.  鄧先生又呈堂了一份由大廈業主立案法團管理委員會主席根據香港法例第344章第22條發出之證明書，進一步證明答辯人總共欠申請人上述的款項共108,437.50元。

18.  基於以上裁斷，現作出以下命令:

(a) 答辯人須向申請人支付第一期至第三期的大廈消防改善工程費及工程備用金分攤金額97,875元;

(b) 答辯人須向申請人支付押記備忘錄(註冊編號: 19040100630016) 律師費7,000元;

(c) 答辯人須向申請人支付地庫單位須承擔的2018年至2020年的公眾第三者責任保險保費及火險保費3,250元;

(d) 答辯人須向申請人支付2019年大廈地庫單位須承擔的公眾沖廁之維修費用312.50元;

(e) 答辯人須向申請人支付上述欠款利息，從判決日開始以判定利率計算，直至付清為止; 及

(f) 答辯人須向申請人支付本申請的訟費，簡易評定為38,000元。
