DECISION ON COSTS

Hon Kwan VP (giving the Decision on Costs of the Court):

1.  On 7 May 2021, the Court of Appeal handed down a judgment dismissing the plaintiff’s two summonses and two notices of motion^[1]. We ordered the plaintiff to pay the costs of the 1^st, 2^nd and 3^rd defendants of the applications.

2.  Pursuant to the directions given in §26 of our judgment, the defendants lodged their respective statements of costs for summary assessment on 14 and 21 May 2021.  The plaintiff has not lodged any submission to object to any item of costs in the defendants’ statements of costs within 14 days thereafter.

3.  The 1^st defendant claimed total costs of $34,125.  We allow $33,000 to be recovered from the plaintiff as reasonable costs.

4.  The 2^nd and 3^rd defendant each claimed $6,890.  We allow $3,100 to each of the 2^nd and 3^rd defendants as reasonable costs.
