He was then standing by the rear passenger door trying to get into the taxi and presumably was close enough to be handling the door lever in order for the taxi driver to have that view. The appellant therefore appears to have been standing very close to the taxi at all material times. There appears to be some merit in Mr Reading’s suggestion that it would have been physically impossible
